中华人民共和国国籍法(附英文)

! b% Y4 I3 x: k% j" A* ^ z 第一条 中华人民共和国国籍的取得、丧失和恢复,都适用本法。
" |& _7 \( ]. k: f! \ 第二条 中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。
# J1 |' k3 w# @. K 第三条 中华人民共和国不承认中国公民具有双重国籍。
! }6 E0 m2 N& O 第四条 父母双方或一方为中国公民,本人出生在中国,具有中国国籍。5 Z0 _& b* ]/ V5 |
第五条 父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。
0 W0 ~1 w. D5 g8 y& B 第六条 父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。
& u, J3 N- y5 J! r+ B 第七条 外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:

二、定居在中国的;3 J: C; K3 C3 z) T( ]$ ~
三、有其它正当理由。
( j: y; x2 |2 \) {# t* @ 第八条 申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。* F& s' {! }' X
第九条 定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。
7 t+ d9 r; n H4 d7 y 第十条 中国公民具有下列条件之一的,可以经申请批准退出中国国籍:

& w$ N6 E- K G6 ]+ I Z 二、定居在外国的;5 Q2 Z6 X: ?' E% N

第十一条 申请退出中国国籍获得批准的,即丧失中国国籍。
+ i! S9 [8 P0 j7 ^) Z( B 第十二条 国家工作人员和现役军人,不得退出中国国籍。
. t; b) [. Z' Z3 u 第十三条 曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。
' K2 A% j& V# d5 d/ p 第十四条 中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。* U& U: [0 Q% F. b4 a3 O1 c4 e% V
第十五条 受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。8 @ |: s+ {2 Y9 c0 `6 ]
第十六条 加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。

This Law is applicable to the acquisition, loss and restoration of

Article 2
8 _6 F9 q, U* l8 W5 yThe People''s Republic of China is a unitary multinational state; persons

nationality.

whose parents is a Chinese national shall have Chinese nationality. But a
1 W( D7 a! V& m* m8 M/ Sperson whose parents are both Chinese nationals and have both settled/ h* O8 @. x# P l0 h
abroad, or one of whose parents is a Chinese national and has settled
; M' e6 u% z& U% @; J# \- Tabroad, and who has acquired foreign nationality at birth shall not have5 l$ n- F- F: M: v% W, d5 g6 t
Chinese nationality.

Any person born in China whose parents are stateless or of uncertain
) r! E0 V; `" v# H9 Inationality and have settled in China shall have Chinese nationality.

Foreign nationals or stateless persons who are willing to abide by China''s1 {9 L$ L/ Z* L. H8 e6 Y! m3 R0 P6 c9 v
Constitution and laws and who meet one of the following conditions may be
4 p; ?, K+ s; `" ], [1 I, C( ^naturalized upon approval of their applications:
4 \2 r! e- u* U$ U7 ? t(1) they are near relatives of Chinese nationals;. B' w& m' A2 S: Z6 ?$ m+ A
(2) they have settled in China; or, I* r6 c# H ~( r6 J3 ~- Y

Article 8
( H% [; O6 e8 t1 BAny person who applies for naturalization as a Chinese national shall
: `, b, O2 ?) ]' i+ }# f: T8 Tacquire Chinese nationality upon approval of his application; a person
7 q6 @, d# s3 ~' f. Nwhose application for naturalization as a Chinese national has been
3 S$ m6 V! T# ?' _approved shall not retain foreign nationality.- M0 ~( m% F9 C3 }2 s2 z4 E
Article 9
8 G5 T( l' S; O# G" ?3 U$ l U9 FAny Chinese national who has settled abroad and who has been naturalized1 g3 Z) w$ _7 h. \- J$ K; y3 o: ~
as a foreign national or has acquired foreign nationality of his own free+ O( H* `1 b) H
will shall automatically lose Chinese nationality.: R" `, L0 j8 _/ e( [

Chinese nationals who meet one of the following conditions may renounce5 J. W4 ]% l2 w" J9 E3 x
Chinese nationality upon approval of their applications:& d) T: a- e( Q# P! @- B& L
(1) they are near relatives of foreign nationals;
2 }; \0 T1 z5 C! q! _(2) they have settled abroad; or
% B( v& |3 ~% P$ ?8 r% r& ~(3) they have other legitimate reasons.

7 |) c) Y& l% V; P4 vAny person who applies for renunciation of Chinese nationality shall lose
" r0 v, O: F5 x1 fChinese nationality upon approval of his application.
. b( Z# v% s2 e- M5 l3 RArticle 12, m) E) h/ L5 n9 \- M0 ]2 n8 g
State functionaries and military personnel on active service shall not ^# I! }, q& T M) ?6 ^! u
renounce Chinese nationality.

* e& ~ {% J0 r2 [( B- qForeign nationals who once held Chinese nationality may apply for0 W/ _ M9 f: R! z7 o. E' L* [
restoration of Chinese nationality if they have legitimate reasons; those
8 R! K' _2 K- I; u' Awhose applications for restoration of Chinese nationality have been
6 T# f V" Y9 a3 `/ gapproved shall not retain foreign nationality.
8 c$ H: s3 [& I2 l9 nArticle 14
- Z9 O; @) X" N0 s3 Z& tPersons who wish to acquire, renounce or restore Chinese nationality, with
# m( }+ f2 [, B3 x2 @the exception of the cases provided for in Article 9, shall go through the6 a2 `) u [# b- ~* q
formalities of application. Applications of persons under the age of 18* [$ R8 W# H7 U* j% |
may be filed on their behalf by their parents or other legal! \; p; E8 O* C, \' O5 {+ s
representatives.( ~: c' ]( N% E: d! x
Article 15
: d# k! m7 k7 fNationality applications at home shall be handled by the public security
6 B m q8 s! X0 ? b! @bureaus of the municipalities or counties where the applicants reside;
5 o4 ~& |9 P8 a9 S6 mnationality applications abroad shall be handled by China''s diplomatic
& E, c* i- r# w0 A: \representative agencies and consular offices.; q$ o2 y8 V3 \" E! L
Article 16
8 P) X8 c) @: u% V) p* O' x$ vApplications for naturalization as Chinese nationals and for renunciation
. L4 G3 c- S+ G( [( n& G. R7 kor restoration of Chinese nationality are subject to examination and
# `/ J2 A; m' Z9 l+ yapproval by the Ministry of Public Security of the People''s Republic of
$ e* p7 f* q1 R9 QChina. The Ministry of Public Security shall issue a certificate to any
# @0 V D+ b! a: K, T9 yperson whose application has been approved.
9 ?2 o0 G5 Y# M" z* C3 pArticle 17- a6 y! b8 A) d: W- z
The nationality status of persons who have acquired or lost Chinese {9 M( `+ X) _, N( K7 D7 t
nationality before the promulgation of this Law shall remain valid.

3 Q, Q9 H7 m. U; C8 \. lThis Law shall come into force on the day of its promulgation. |
