第一条   中华人民共和国国籍的取得、丧失和恢复,都适用本法。& r, n$ ?" `7 t( \3 c5 k/ b# N
    第二条   中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。( u4 ?. m- A& K) D6 S% O
    第三条    中华人民共和国不承认中国公民具有双重国籍。5 P4 Q7 T- \1 j; l6 x$ L# o
    第四条   父母双方或一方为中国公民,本人出生在中国,具有中国国籍。
8 P3 g. D9 q+ d9 u$ ~( p8 y* |# M    第五条   父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。
! s5 t, P, ]) W) E( J5 {0 U    第六条   父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。
1 q! g9 d1 M! }+ |% N% j1 ?    第七条   外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:$ X# n* m6 {) n( s9 Y2 S8 {
    一、中国人的近亲属;
* P+ P. j; ^# I    二、定居在中国的;/ {" X: z' w0 S+ v) u4 r
    三、有其它正当理由。
+ U2 y0 m7 A+ i% {& N7 l    第八条   申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。6 ^6 ~, g% t" z& |
    第九条    定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。
2 t  q6 ^9 F$ D9 T- F4 S    第十条    中国公民具有下列条件之一的,可以经申请批准退出中国国籍:
0 b/ J' F* }, E7 f- _    一、外国人的近亲属;
" B! p0 ^# c( [8 c    二、定居在外国的;/ \& k6 a1 i+ T- e3 o
    三、有其它正当理由。/ d; R7 K, @6 d9 f! S4 O* o( a
    第十一条    申请退出中国国籍获得批准的,即丧失中国国籍。% t" `5 p' D3 p5 G
    第十二条   国家工作人员和现役军人,不得退出中国国籍。* F* b2 f; z& @
    第十三条   曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。4 [* g. ?: @: |$ E2 c
    第十四条   中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。0 s/ m2 H- Y7 {8 j7 B' G; x
    第十五条    受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。9 k' J6 d; x. K# H
    第十六条   加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。
7 ]( C) L9 s0 s1 r    第十七条   本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。+ I* Q9 m7 Z! K$ X
    第十八条   本法自公布之日起施行。; `5 P- R6 Z: H

" w3 f" n# |( ?4 E( v  EThis Law is  applicable  to  the  acquisition,  loss  and  restoration  of
- O! ^$ }2 v& K8 k  Xnationality of the People''s Republic of China.
: y3 @: G( D3 t* j3 J/ g# _Article 24 H% F: N+ x9 u# [  E3 N' y) d
The People''s Republic of China is a unitary multinational  state;  persons: q* Y$ H* ?- m: k2 K$ K; B- [
belonging to  any  of  the  nationalities  in  China  shall  have  Chinese5 `. @, O3 u0 |  W! y
nationality.5 T" l9 r) l# J
Article 3" @# |* B/ u( t- l( F; x
The People''s Republic of China does not recognize dual nationality for any; P1 o$ ]0 v. K( j! Y
Chinese national.; t& V$ n% `7 f  |7 ^6 g3 p& x
Article 4
0 O( _  _: D& q: T: N* QAny person born in China whose parents are both Chinese nationals  or  one2 \9 m8 b) z  Z# c9 {9 Z7 u9 \
of whose parents is a Chinese national shall have Chinese nationality.
& l) C  D" M, y1 RArticle 56 {5 c9 M4 v/ v) G, j/ r$ X6 ]' I" z
Any person born abroad whose parents are both Chinese nationals or one  of+ g6 R% @( X+ D/ t! y% L) }  Z
whose parents is a Chinese national shall have Chinese nationality. But  a
7 f/ D- v" C9 h5 K4 X% K9 N3 W9 Eperson whose parents are both Chinese  nationals  and  have  both  settled6 ]% [. ?* x/ r$ s! S  h3 W
abroad, or one of whose parents is a  Chinese  national  and  has  settled+ S7 z7 Y8 m$ Q& k; f. ]
abroad, and who has acquired foreign nationality at birth shall  not  have4 L! s6 r/ j* @3 p
Chinese nationality.
1 t: R: F$ }- [5 i2 Z7 Z- r" R' Y6 vArticle 6
- n- l% a$ A3 gAny person born in China whose  parents  are  stateless  or  of  uncertain, W  A3 A( c/ C/ a
nationality and have settled in China shall have Chinese nationality.5 r, E% X1 ]+ F0 ~
Article 7; p4 w' i: d$ ~# f1 m. K$ i
Foreign nationals or stateless persons who are willing to abide by China''s" B, X0 S. u, S: n
Constitution and laws and who meet one of the following conditions may  be9 f4 ~7 k$ l  N4 ~; G
naturalized upon approval of their applications:
  l! k% L3 }& m0 j5 Q) r(1) they are near relatives of Chinese nationals;+ n; j9 K9 _' W7 F: I! V+ S4 ~+ o
(2) they have settled in China; or
& W3 K. r) U2 c" g0 c  _8 z: b) ~(3) they have other legitimate reasons.
; n5 M# x& ]; o( C3 |% _7 gArticle 8
. ~7 \& U) ]/ T* U3 T  UAny person who applies for naturalization  as  a  Chinese  national  shall: H9 Y6 n' j2 L  K6 M! h
acquire Chinese nationality upon approval of  his  application;  a  person
, Z5 U" w0 _$ d3 Y* y% z6 V) Bwhose application for  naturalization  as  a  Chinese  national  has  been- K, n4 }/ L( I+ T
approved shall not retain foreign nationality.1 }+ F# c2 [: `
Article 93 k, f( Y- b$ O4 r
Any Chinese national who has settled abroad and who has  been  naturalized  S9 @: _0 I7 J
as a foreign national or has acquired foreign nationality of his own  free
# b: M$ w/ V6 L- [" [" }will shall automatically lose Chinese nationality.9 `+ |* B' G# k5 F9 [- p6 {
Article 10, p  G* C8 t3 Y5 z& I+ _
Chinese nationals who meet one of the following  conditions  may  renounce% Z: o) w" a# o8 d9 l% X. p
Chinese nationality upon approval of their applications:- i2 z$ ], {( d' l" H/ a' i
(1) they are near relatives of foreign nationals;9 |' y8 g9 K/ \4 Q; w2 B, q
(2) they have settled abroad; or8 x; |+ a9 M5 r1 }$ B- l% m1 G& T
(3) they have other legitimate reasons.
+ p: b* x& O$ B& l7 V6 H5 PArticle 11
- x: o9 M  A6 g4 \0 DAny person who applies for renunciation of Chinese nationality shall  lose
8 D; m# I6 x$ P' A" lChinese nationality upon approval of his application.
  U! O! K% J# R$ o4 a9 f' ?Article 12- [1 k" T0 o2 X( d4 v; `. F5 D( M
State functionaries and military personnel on  active  service  shall  not; y2 c6 Q5 {2 m5 l9 ^1 k+ d
renounce Chinese nationality.
  V% ]) y# Z$ |4 O* sArticle 13
% D3 Z% ?' H& ^0 H# i# q# rForeign  nationals  who  once  held  Chinese  nationality  may  apply  for4 {3 i9 w' l  t1 B6 w8 w
restoration of Chinese nationality if they have legitimate reasons;  those
, ]- ^% c% ~, Z. W/ Hwhose applications  for  restoration  of  Chinese  nationality  have  been
. y$ P  H+ B; R" o5 ]' qapproved shall not retain foreign nationality.) }1 w; X  o+ {3 J% j
Article 14
; j& D: c/ @3 v) W5 W4 FPersons who wish to acquire, renounce or restore Chinese nationality, with
  [: M) o8 I8 e7 Mthe exception of the cases provided for in Article 9, shall go through the
9 w) o# }( u- W# S+ a/ r# y1 pformalities of application.  Applications of persons under the age  of  18
& K3 w, ^9 N/ Ymay  be  filed  on  their  behalf  by  their  parents   or   other   legal
& d( u1 n- E0 A/ I! v6 vrepresentatives.& g  {0 t; B! k6 ^
Article 15+ P( F1 l, D2 M9 ], H5 g
Nationality applications at home shall be handled by the  public  security- Q5 R" j  S/ x5 J5 C. ~. g6 N
bureaus of the municipalities or counties where the applicants reside;! T7 y' Z# F5 A% ?
nationality applications abroad shall be  handled  by  China''s  diplomatic; v$ j& j* \! {6 O' A# d: C. e
representative agencies and consular offices.( q4 B3 r: c1 Z& D
Article 16- E" z3 X( W; K
Applications for naturalization as Chinese nationals and for  renunciation
2 P' I! \8 M( {9 H/ Q+ x3 A/ For restoration of Chinese  nationality  are  subject  to  examination  and
! Z$ z% E% [2 F4 i* O( Lapproval by the Ministry of Public Security of the  People''s  Republic  of
. a2 e6 a( Q' u$ w4 Q% q# i3 \China. The Ministry of Public Security shall issue a  certificate  to  any
5 m$ [: K/ X9 y2 L& ~/ \3 w! Jperson whose application has been approved.
1 M# K* s. c1 i. n% X: zArticle 17; ?* P7 m1 Q. Q
The nationality status of  persons  who  have  acquired  or  lost  Chinese
3 J4 z: K; [+ x2 H5 Pnationality before the promulgation of this Law shall remain valid.9 e- g( n. z- M% `
Article 18, L9 A8 M1 G- s, |# e1 C! O
This Law shall come into force on the day of its promulgation.
