《中华人民共和国国籍法》 % W, z1 q! N8 Y7 g
 
: W. F' E0 o: e9 ~" p: { 第一条   中华人民共和国国籍的取得、丧失和恢复,都适用本法。
+ t( f' a: M% I; F2 [: q    第二条   中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。- G4 R9 W& J5 f4 @; g5 U
    第三条    中华人民共和国不承认中国公民具有双重国籍。) K, N8 \$ j, n2 g" ~5 j
    第四条   父母双方或一方为中国公民,本人出生在中国,具有中国国籍。
, ^! d' O3 [' X5 Y9 r7 G    第五条   父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。( r, j+ I8 _1 u# j' }% ]$ R
    第六条   父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。4 X( H( D1 S: a
    第七条   外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:
3 P1 T5 l( }! o4 L  Z" f    一、中国人的近亲属;$ q2 w) }, E; h6 K
    二、定居在中国的;3 N8 R- S2 K% j+ B; T
    三、有其它正当理由。6 H) ^% ?7 _" }
    第八条   申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。' y  \' m  l3 W1 I
    第九条    定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。9 {" o( `0 S0 h& b/ ?) F$ a* H" A
    第十条    中国公民具有下列条件之一的,可以经申请批准退出中国国籍:& u& `5 m; P" {
    一、外国人的近亲属;
9 [6 B0 h8 k- {, c& I4 [! U    二、定居在外国的;5 N2 ?; d& ^: |2 `, G
    三、有其它正当理由。; d/ _  }: N4 w  m- v$ @
    第十一条    申请退出中国国籍获得批准的,即丧失中国国籍。1 t9 a# v7 f) `& U
    第十二条   国家工作人员和现役军人,不得退出中国国籍。4 a7 H$ T- R) q2 o
    第十三条   曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。
) ]+ T) ?% Y& E; x. L% R9 e- Q' J    第十四条   中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。
2 u+ E6 x) O% y" M; `3 K) T" h' g    第十五条    受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。
5 ~" f% T) N3 T5 v6 x& I9 m/ h7 i    第十六条   加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。
( }+ N6 w& g& ]/ w3 X$ [    第十七条   本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。

Congress, promulgated by Order No. 8  of  the  Chairman  of  the  Standing
3 d! l8 h; ^8 M3 N2 l% L# OCommittee of the  National  People''s  Congress  on  and  effective  as  of

Article 1, s4 y; r6 f9 n* [1 [3 l
This Law is  applicable  to  the  acquisition,  loss  and  restoration  of
% k+ d- c. E" v7 Q$ ^0 S* w+ ~nationality of the People''s Republic of China.) p; D6 d+ b/ h2 Z) s9 Y; j
Article 2
2 b4 z' ?# j, H! lThe People''s Republic of China is a unitary multinational  state;  persons; T: o0 F- |& ]) x" `2 P
belonging to  any  of  the  nationalities  in  China  shall  have  Chinese& z" N; l- j- n; ?- |
nationality.
% o) _# u8 t4 ^  t7 |Article 37 {- M# |3 q2 P# k
The People''s Republic of China does not recognize dual nationality for any
2 ~" O, v7 }% M5 xChinese national.
2 I4 L: [3 J) l1 U8 I8 w; b: ~Article 4
# I0 p# t+ q" M$ h& KAny person born in China whose parents are both Chinese nationals  or  one8 e" t3 G* c  l7 x8 q
of whose parents is a Chinese national shall have Chinese nationality.3 S1 i0 `# \* C, h+ ^
Article 5
* ?' z2 ~0 ~4 D' T" A5 mAny person born abroad whose parents are both Chinese nationals or one  of
; M7 Q5 l+ j" v  _$ H/ E8 t. Qwhose parents is a Chinese national shall have Chinese nationality. But  a
. A7 ]; K6 w3 k9 M6 xperson whose parents are both Chinese  nationals  and  have  both  settled
$ \) H+ I7 ~1 iabroad, or one of whose parents is a  Chinese  national  and  has  settled
0 j/ }6 a# _/ `- |abroad, and who has acquired foreign nationality at birth shall  not  have
  N( T+ X4 H5 N& {Chinese nationality.( J: B* x6 O% @% p% T
Article 6
3 r8 C* I8 w6 \; |( ]Any person born in China whose  parents  are  stateless  or  of  uncertain4 y) {! m4 N8 o4 v  g# l; _
nationality and have settled in China shall have Chinese nationality.
" Y' }6 ]/ J* Q) d( [  kArticle 7' t$ s  Q) ]& @, o( t
Foreign nationals or stateless persons who are willing to abide by China''s. Z4 {# @5 B1 u( G2 W$ L
Constitution and laws and who meet one of the following conditions may  be
% `6 p. J+ l! x' z: M' l. gnaturalized upon approval of their applications:5 z6 |: N4 X; N* p8 ?# W
(1) they are near relatives of Chinese nationals;
" b; A! B  p! P4 r(2) they have settled in China; or! h% {9 M1 j. f$ W  @
(3) they have other legitimate reasons.1 `& ^! r" c1 f' V
Article 8
% ^, g2 w# c( o7 F& r7 v" c6 E- f' zAny person who applies for naturalization  as  a  Chinese  national  shall" v) f* G, u$ q- u, O+ h( B& d
acquire Chinese nationality upon approval of  his  application;  a  person
# ~" w' [2 b0 T1 Twhose application for  naturalization  as  a  Chinese  national  has  been8 o  E7 Z0 M" ]- G) X+ @/ ]7 Z/ L
approved shall not retain foreign nationality.
+ a; w5 {9 m! NArticle 9" x0 i7 O0 P9 b$ g: t( B
Any Chinese national who has settled abroad and who has  been  naturalized
& q- G" X8 c) jas a foreign national or has acquired foreign nationality of his own  free
; q/ D6 a: ~/ S% v  C% T1 }will shall automatically lose Chinese nationality.
9 ^2 |8 L. K6 _Article 10. S/ k/ l' h+ [; J/ O& y; g
Chinese nationals who meet one of the following  conditions  may  renounce
" H# D9 [6 ?3 O0 gChinese nationality upon approval of their applications:
0 }" B# h& Q" Y(1) they are near relatives of foreign nationals;
  S( K% l- f* n- w(2) they have settled abroad; or
! z7 @; Q: q; S4 s(3) they have other legitimate reasons.

Any person who applies for renunciation of Chinese nationality shall  lose
! }$ C( b$ o% c1 e! N  HChinese nationality upon approval of his application.
$ H+ ]0 B$ c+ N8 F! E# \' O1 M& jArticle 12
0 `9 X4 V: n/ k) A& H& X1 n9 HState functionaries and military personnel on  active  service  shall  not
& N8 P4 Z! _/ C) F9 Irenounce Chinese nationality.
1 P) ^2 ^6 P% K5 x+ fArticle 13
8 E9 F( M7 C5 t1 o: |5 s' dForeign  nationals  who  once  held  Chinese  nationality  may  apply  for  Y& `# M: j/ M3 @, _; o! h) `
restoration of Chinese nationality if they have legitimate reasons;  those* j* U# `9 }2 U( s* u
whose applications  for  restoration  of  Chinese  nationality  have  been
6 z/ ?, m+ E' t0 I5 g6 }approved shall not retain foreign nationality.2 L0 C! ^4 {5 e4 Y+ H' ^) e  A
Article 14+ p$ f+ n( y! l2 n: T9 \
Persons who wish to acquire, renounce or restore Chinese nationality, with
. ?0 K; O" k/ [the exception of the cases provided for in Article 9, shall go through the) K4 E: E+ Q3 g& _
formalities of application.  Applications of persons under the age  of  18
: t. [) x7 T* smay  be  filed  on  their  behalf  by  their  parents   or   other   legal
/ x/ W, O5 |9 s8 t- y6 L  trepresentatives.
" p( ^/ R( \/ a$ y- }Article 15
6 t: S+ k' V4 DNationality applications at home shall be handled by the  public  security
0 f5 @7 F2 m$ U; N) Sbureaus of the municipalities or counties where the applicants reside;
  G) R! i. U+ Qnationality applications abroad shall be  handled  by  China''s  diplomatic
" h5 [. N' l* \! L) i0 drepresentative agencies and consular offices.
4 ^6 p9 g* h3 P- R% C4 ^Article 16! o! m1 t: c  a" b8 @1 ^  C
Applications for naturalization as Chinese nationals and for  renunciation$ D1 F. W5 u% L" F/ |. n; Q
or restoration of Chinese  nationality  are  subject  to  examination  and& q9 q6 @8 q) A
approval by the Ministry of Public Security of the  People''s  Republic  of
5 b( K( k) Z- c% OChina. The Ministry of Public Security shall issue a  certificate  to  any
% ^% }  T7 a1 P" ^/ xperson whose application has been approved.
0 n* z+ D1 k9 J" p/ D* p! Q1 uArticle 178 t3 \4 p0 E7 B: f7 }, S# J
The nationality status of  persons  who  have  acquired  or  lost  Chinese
0 N3 f. t/ {6 x" M  c; Gnationality before the promulgation of this Law shall remain valid.9 H9 d' R3 W- K. j; |, m. q$ }
Article 18
8 T, c  I7 k* @% V- ]0 mThis Law shall come into force on the day of its promulgation.
