. y$ r( G3 r8 s. _7 q6 x 第一条 中华人民共和国国籍的取得、丧失和恢复,都适用本法。
0 q& ?$ ~: m$ @! {$ @2 k& x8 x 第二条 中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。& A2 D( Q- o9 o& U
第三条 中华人民共和国不承认中国公民具有双重国籍。; X, j, }& w4 r" ^
第四条 父母双方或一方为中国公民,本人出生在中国,具有中国国籍。
) `* f; ?: b" Y" o, v; q( l5 O 第五条 父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。
' `+ d/ t- H0 O' n 第六条 父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。
# t0 r8 H* i# P1 W- o 第七条 外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:

第八条 申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。* X4 [8 z6 N a, l4 Z% n4 |
第九条 定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。
1 M, Z9 S- z3 ` 第十条 中国公民具有下列条件之一的,可以经申请批准退出中国国籍:, z5 d& m' }: Y) X. V8 S
一、外国人的近亲属;* \, N4 G$ r, N& K
二、定居在外国的;
4 h! o7 N( t: D9 y$ t! T 三、有其它正当理由。
! Q' G5 m7 O* G# ^; A 第十一条 申请退出中国国籍获得批准的,即丧失中国国籍。6 t, e4 M0 H, ]; n' }: s
第十二条 国家工作人员和现役军人,不得退出中国国籍。
7 T2 J1 R1 D% C# T, a+ N! @, _ 第十三条 曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。
* G) ~% z! P* S+ u f7 r" Y 第十四条 中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。
* X' L' z4 t: e$ l" w* B r: \$ s 第十五条 受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。
0 [3 E1 v, V1 u: Z$ } 第十六条 加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。
/ s( b7 j {1 W7 K$ g! n* H 第十七条 本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。
1 h6 t. U6 |: I* j8 n 第十八条 本法自公布之日起施行。

This Law is applicable to the acquisition, loss and restoration of* _* r# S& a# M) m* O
nationality of the People''s Republic of China.

The People''s Republic of China is a unitary multinational state; persons! ^$ e! c' a5 \ u5 n2 u" }
belonging to any of the nationalities in China shall have Chinese

Article 3
! {' _% M. E9 `. j. Q7 T, Z/ ^1 U$ pThe People''s Republic of China does not recognize dual nationality for any

Any person born in China whose parents are both Chinese nationals or one' u1 e: j; m1 y9 V" }
of whose parents is a Chinese national shall have Chinese nationality.' `, l" d% _" @
Article 5
- H1 H2 K1 H% p9 PAny person born abroad whose parents are both Chinese nationals or one of
# c. F f m$ x! J! q" J: \) t+ Ywhose parents is a Chinese national shall have Chinese nationality. But a
8 y) ^* ]) ~. w X+ rperson whose parents are both Chinese nationals and have both settled
4 s4 y0 ~* J4 c. ]7 }" h2 j! E" r" Sabroad, or one of whose parents is a Chinese national and has settled ?' F4 s+ Y9 n
abroad, and who has acquired foreign nationality at birth shall not have

Any person born in China whose parents are stateless or of uncertain
! z1 _3 H0 Q& N4 [, Q1 s, jnationality and have settled in China shall have Chinese nationality.

Foreign nationals or stateless persons who are willing to abide by China''s
0 E' E* k+ q, J" q, E: L8 _Constitution and laws and who meet one of the following conditions may be: |! z7 t# `2 B7 }+ D
naturalized upon approval of their applications:
! \4 n+ f0 C4 J" a9 M8 [(1) they are near relatives of Chinese nationals;
& U& d0 F$ V5 s( B+ ~% J2 f/ y(2) they have settled in China; or
5 m" @! h! x Z% x8 E& B1 X, d(3) they have other legitimate reasons.# c* ?7 f/ ~5 ^2 K6 V* w; X% g
Article 8
( u: y- V5 \* I. d" L" PAny person who applies for naturalization as a Chinese national shall
& t' _9 }" ]* a9 ]* a. h$ y# p3 sacquire Chinese nationality upon approval of his application; a person
8 O7 ]( a3 H U) ~6 X2 t# P$ Mwhose application for naturalization as a Chinese national has been/ N: j* |0 p' f6 X; }0 b
approved shall not retain foreign nationality.# N( h( R9 d. |, H9 \ u; x6 }
Article 9
! Q- C# \4 e, U# Y( s4 `Any Chinese national who has settled abroad and who has been naturalized$ y, O( k5 T" E
as a foreign national or has acquired foreign nationality of his own free1 |$ Q: X6 e) M# S0 D
will shall automatically lose Chinese nationality.
3 z" y' B3 X( cArticle 10; ^; ?4 V" r( N' Y# s
Chinese nationals who meet one of the following conditions may renounce
g" o8 N) ~/ H. U( D- A/ VChinese nationality upon approval of their applications:+ q9 a% F( l0 u' Z
(1) they are near relatives of foreign nationals;& e. R2 I/ M. l# A* I
(2) they have settled abroad; or
H' b% S( V: O6 E0 x( `( x(3) they have other legitimate reasons.
& c* Y0 ^- d- s. hArticle 11; h1 H9 N, J4 Z' D6 N. D9 e3 g
Any person who applies for renunciation of Chinese nationality shall lose
, R& S" c9 L6 k1 A5 ]Chinese nationality upon approval of his application.( g6 l. }0 r8 d- u5 L& R) [4 M
Article 12
. e" I" v- w/ D8 v/ T: gState functionaries and military personnel on active service shall not
, I2 H, e. `- ~0 ~/ j6 brenounce Chinese nationality.5 l; o3 I: s% n. M( {
Article 13
" x6 ]8 `" q( w) ?; q3 L4 ^Foreign nationals who once held Chinese nationality may apply for1 O" P, [ G- X
restoration of Chinese nationality if they have legitimate reasons; those
0 E0 [9 W. I$ x! i8 V2 ]9 vwhose applications for restoration of Chinese nationality have been
7 b1 b) m5 Q$ Rapproved shall not retain foreign nationality.' @( Z M* A) B3 i
Article 14
. T# \) P5 B$ ePersons who wish to acquire, renounce or restore Chinese nationality, with' ?6 z* y/ o; s _; u& S0 `
the exception of the cases provided for in Article 9, shall go through the$ b( n8 p0 M; F9 e$ a
formalities of application. Applications of persons under the age of 18
& l" A! V$ P/ o: r1 ^! P$ }9 n! f3 Imay be filed on their behalf by their parents or other legal7 H Y& S+ d" S
representatives.& y* q1 i. ~, W: v; t' c0 h
Article 155 S& v) G: M" j! E( X
Nationality applications at home shall be handled by the public security) g3 x9 f" t7 {) B0 B* } ]8 I
bureaus of the municipalities or counties where the applicants reside;; }& Q* ~( ^+ @7 x
nationality applications abroad shall be handled by China''s diplomatic7 y; d2 w( \# w' F8 L
representative agencies and consular offices.2 I/ b9 V+ c J/ U
Article 16
( t% c! `! P4 K% [8 l# t& Z; Q, KApplications for naturalization as Chinese nationals and for renunciation* C5 Z* X* ]0 E$ A% a4 f C$ N
or restoration of Chinese nationality are subject to examination and
/ p& p7 e$ X! P: d. v; N- c+ dapproval by the Ministry of Public Security of the People''s Republic of
. S Y1 J/ m3 b: i& W; z4 L$ o5 p( FChina. The Ministry of Public Security shall issue a certificate to any( K# t- I% Z6 J+ w' k! E1 X5 p
person whose application has been approved.& I0 k- X: n2 q6 W7 N
Article 17
! D$ K3 ~) N7 x2 r$ CThe nationality status of persons who have acquired or lost Chinese
) R" [( F+ `( I7 Znationality before the promulgation of this Law shall remain valid.
6 Y: ^- K5 c; U1 }( T: f# K( I3 JArticle 18. c# d* C! E- }! L5 a9 @' i2 w
This Law shall come into force on the day of its promulgation. |
