《中华人民共和国国籍法》

$ |7 _5 s& g5 B, a! U" z! l 第一条   中华人民共和国国籍的取得、丧失和恢复,都适用本法。
. z0 M3 t9 g4 D' V5 \6 C5 I& F    第二条   中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。
) {! J% `: f5 v- z1 L# J    第三条    中华人民共和国不承认中国公民具有双重国籍。% [% F$ j: T$ J5 g6 I( F
    第四条   父母双方或一方为中国公民,本人出生在中国,具有中国国籍。7 E  H/ M4 l3 s3 y
    第五条   父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。5 x2 C# I" g0 s  Y" _. r* v
    第六条   父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。& y5 u% H! T9 N8 P
    第七条   外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:
: Z4 v1 H# b% g) {    一、中国人的近亲属;; @5 i; C; G+ Z$ T1 h- a  z' L
    二、定居在中国的;
, [& h; N" T; U# e& V4 I+ l! j    三、有其它正当理由。
  B: {4 c" G, r+ p    第八条   申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。
0 M5 B  d9 E7 o8 o7 e    第九条    定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。1 ~; R( d3 h4 X! f6 ]2 z5 D
    第十条    中国公民具有下列条件之一的,可以经申请批准退出中国国籍:. k) g' f8 V& d4 q4 G
    一、外国人的近亲属;  U5 z" W, c$ a# t1 S
    二、定居在外国的;
4 f. |2 d( p3 w: g! z  Z    三、有其它正当理由。
( ^) J4 h3 z5 \$ L6 Z3 H    第十一条    申请退出中国国籍获得批准的,即丧失中国国籍。5 b  t+ c: r+ F7 N/ N$ p7 N
    第十二条   国家工作人员和现役军人,不得退出中国国籍。0 j; M' X2 |% i$ ~3 ]2 O/ q! ~
    第十三条   曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。/ R3 z- `0 G: J" \0 ~$ j) g
    第十四条   中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。
* }, e2 [/ g, l    第十五条    受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。
( `" Z2 A1 e- T, C' A. e8 U    第十六条   加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。3 ~7 ^& a2 p) B# ?5 `+ E
    第十七条   本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。6 U0 i/ S' x5 T  g: [; ~
    第十八条   本法自公布之日起施行。9 G/ L3 E% w% {6 x

This Law is  applicable  to  the  acquisition,  loss  and  restoration  of
# w+ g3 W6 V2 \) O( n, ~nationality of the People''s Republic of China.; P9 A+ G. r4 C: t! |6 Z; H
Article 2; Z0 g! s0 w* V, `
The People''s Republic of China is a unitary multinational  state;  persons' Q. U; Z! [+ u1 L7 c& G6 L' @8 X
belonging to  any  of  the  nationalities  in  China  shall  have  Chinese" i' ~3 Q; B0 E4 [
nationality.
6 j& l6 j8 o; l2 ~& B5 Y& c6 zArticle 3* j% C- s4 @" p, z6 U! ^4 X0 H' ?1 J
The People''s Republic of China does not recognize dual nationality for any
. ?- ]: @! z+ Y+ I6 G8 xChinese national.

# K% o8 V  ~9 M" Q7 v/ MAny person born in China whose parents are both Chinese nationals  or  one, n( c4 t/ v, d9 t" B8 q+ |
of whose parents is a Chinese national shall have Chinese nationality.
$ P. s, [! }0 H' s7 lArticle 5
  m8 g, e+ m" LAny person born abroad whose parents are both Chinese nationals or one  of7 e( ~4 N3 d% }/ h' m/ ?9 d
whose parents is a Chinese national shall have Chinese nationality. But  a
( O) n6 u: {9 V, nperson whose parents are both Chinese  nationals  and  have  both  settled
9 _5 T% `& u( _. c& Gabroad, or one of whose parents is a  Chinese  national  and  has  settled
+ n9 Q. Y5 u( j& V# Zabroad, and who has acquired foreign nationality at birth shall  not  have
0 j. x2 i9 _, h- G4 K# @Chinese nationality.
3 Q% m8 V  i' Z& O8 GArticle 6
6 t: p0 g: m7 TAny person born in China whose  parents  are  stateless  or  of  uncertain. P# Y: T) \1 q4 y) y- i; x
nationality and have settled in China shall have Chinese nationality.
1 c: N$ F/ W/ ?  |3 D$ M( lArticle 7
7 T  G7 k" Q, `Foreign nationals or stateless persons who are willing to abide by China''s
+ B& l4 Q1 X  e3 sConstitution and laws and who meet one of the following conditions may  be/ t$ g, _& U+ A& F# o# Z
naturalized upon approval of their applications:
9 u' {8 f& e: I: c+ q2 i+ ?* H* h(1) they are near relatives of Chinese nationals;4 M6 f: P; p  F! V1 f* t4 B
(2) they have settled in China; or
3 ?& p8 h, b+ k0 h(3) they have other legitimate reasons.
2 `9 l0 s& N, Y/ o6 ]" x5 gArticle 8
, R* L" U# w+ E# OAny person who applies for naturalization  as  a  Chinese  national  shall! V+ Y. ^" H3 |! ^9 {
acquire Chinese nationality upon approval of  his  application;  a  person% T2 ?( ^3 [4 q8 P
whose application for  naturalization  as  a  Chinese  national  has  been9 W& X5 a7 V- f3 \
approved shall not retain foreign nationality.
. w+ t- _1 @  {5 a5 n9 UArticle 92 f6 t3 l, w  _% ~7 g3 E; B
Any Chinese national who has settled abroad and who has  been  naturalized
* n" l1 _' I# ~3 {, tas a foreign national or has acquired foreign nationality of his own  free
8 {, A( I" d' s. t% t% a. }+ }9 uwill shall automatically lose Chinese nationality.
( [& n/ D7 E7 ~/ PArticle 10+ I$ N; j' D6 }3 Z8 |3 Q# U7 S: Z
Chinese nationals who meet one of the following  conditions  may  renounce
5 q/ D& S/ p! B7 KChinese nationality upon approval of their applications:
- V  g1 W; ]- R(1) they are near relatives of foreign nationals;0 e6 D& u2 i8 t) c- H7 K7 ^/ C
(2) they have settled abroad; or
2 R, F6 J0 K1 B$ K(3) they have other legitimate reasons.: ]  X( a$ B& w/ G2 Q$ A" C5 A  e
Article 11  O5 x5 Y4 f* y' S
Any person who applies for renunciation of Chinese nationality shall  lose1 ?2 M' j4 h: r* y& b* H
Chinese nationality upon approval of his application.) e5 d, a: N3 g- v% a/ F
Article 12
+ l2 w2 d5 d2 O. Z9 Q' Q- l# j  nState functionaries and military personnel on  active  service  shall  not
# a6 \! U% b1 T# }renounce Chinese nationality.5 _: b& X. p# m* N' |1 P/ ?+ N( M; Z
Article 13
1 q+ q; |3 P# l. y. D; ^  |( kForeign  nationals  who  once  held  Chinese  nationality  may  apply  for
" A" a5 d: a+ e$ vrestoration of Chinese nationality if they have legitimate reasons;  those
$ ?' p- u2 E0 f1 @whose applications  for  restoration  of  Chinese  nationality  have  been* n2 @+ c2 d* ~' A+ G8 j5 Y1 _& H
approved shall not retain foreign nationality.4 D" U# K, f, {" b
Article 14
+ f% H3 X' `5 b$ v2 i' qPersons who wish to acquire, renounce or restore Chinese nationality, with4 W# K$ `  Q7 t3 G" [3 g6 F
the exception of the cases provided for in Article 9, shall go through the
% U% F% P8 S) H, \& bformalities of application.  Applications of persons under the age  of  18* T0 g/ h+ x0 e5 g
may  be  filed  on  their  behalf  by  their  parents   or   other   legal$ N8 @' |2 q/ H% I2 {! R+ p
representatives.
) C1 ^$ Q; _4 l+ }( ^Article 15' D' h6 m/ O2 E7 N9 Z; X
Nationality applications at home shall be handled by the  public  security
  o# ~. T: N! c# D& h6 P( tbureaus of the municipalities or counties where the applicants reside;
$ F. o& R6 K8 u0 W& @nationality applications abroad shall be  handled  by  China''s  diplomatic1 a3 m: k" ]  T! S0 E" b2 D
representative agencies and consular offices.' c' x3 n4 {9 q
Article 16# l. R& Q* |9 b' c
Applications for naturalization as Chinese nationals and for  renunciation9 a" y' i3 W4 H( L, n
or restoration of Chinese  nationality  are  subject  to  examination  and4 n! Y7 Z/ D9 I
approval by the Ministry of Public Security of the  People''s  Republic  of
: z( G! v$ l. D- iChina. The Ministry of Public Security shall issue a  certificate  to  any* y% `# g  B6 V; Z& A; }4 ^
person whose application has been approved.
$ f+ N7 P& o0 F/ l: x" kArticle 171 b, D. e* h5 C/ X) f
The nationality status of  persons  who  have  acquired  or  lost  Chinese
( f! [- v. d; F5 E  o3 J; P" hnationality before the promulgation of this Law shall remain valid.
( g0 V2 N9 Z$ b8 HArticle 18
2 [# e/ G1 f- ~$ B; b, r- [" Z0 wThis Law shall come into force on the day of its promulgation.
