* H: K/ c1 }1 ]$ }《中华人民共和国国籍法》 , Q' g: Q' A1 G. @; R
 
0 K9 \; j" U' o. M3 [- D9 `' i5 E 第一条   中华人民共和国国籍的取得、丧失和恢复,都适用本法。
2 D$ {- f5 t! ], y; V- d. M- i    第二条   中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。2 {+ H. S: F5 \  P' a
    第三条    中华人民共和国不承认中国公民具有双重国籍。  ]) n( s# D+ f: j! Z; ^' ~
    第四条   父母双方或一方为中国公民,本人出生在中国,具有中国国籍。
' }! V: e* _/ r9 j    第五条   父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。& F% w, p% r9 E8 w- y
    第六条   父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。# a. |+ B7 m  V) s
    第七条   外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:5 C  ^7 M3 X; v5 [6 R" k
    一、中国人的近亲属;  h" O- ]: q! ]: t3 U# R
    二、定居在中国的;1 C/ K3 S  z; q8 }& ?
    三、有其它正当理由。
9 D# u& X  \" |* x    第八条   申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。, M3 k' ?7 N* X9 U: C) y
    第九条    定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。
$ A: r5 T. N" o0 p( u3 D" E4 f# s    第十条    中国公民具有下列条件之一的,可以经申请批准退出中国国籍:
8 t6 [% Y# r, z; d. `) ~    一、外国人的近亲属;* {+ s9 B, p( [, X% D2 x; n+ y
    二、定居在外国的;
3 s' e- c$ N+ X0 e4 l! V8 J6 b    三、有其它正当理由。. i5 B- O; Q: d8 S
    第十一条    申请退出中国国籍获得批准的,即丧失中国国籍。
  j  A$ ?1 L7 \3 }2 z; H+ w( `2 o. u    第十二条   国家工作人员和现役军人,不得退出中国国籍。
: n& ?; q4 T- H+ A' q# z" c    第十三条   曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。
6 {- |6 M3 L+ Z+ z    第十四条   中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。
0 a9 G% |% g, l. D    第十五条    受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。
3 ?6 x4 J" H3 e3 j0 _  J. P    第十六条   加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。) @  t, z# Q' J; n
    第十七条   本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。

0 R& ^) w& G$ z( H( xCongress, promulgated by Order No. 8  of  the  Chairman  of  the  Standing
/ ~4 j- @: A% m# u7 h$ aCommittee of the  National  People''s  Congress  on  and  effective  as  of
" n3 v! U; [5 t& ISeptember 10, 1980)

This Law is  applicable  to  the  acquisition,  loss  and  restoration  of
/ B6 P: v0 A3 x. @nationality of the People''s Republic of China.
$ \' ~- n* r  A# HArticle 2
5 b* O0 [/ k. gThe People''s Republic of China is a unitary multinational  state;  persons
( v4 \8 E2 p  o8 Vbelonging to  any  of  the  nationalities  in  China  shall  have  Chinese; U! f7 p# y3 W, H6 @; C1 Z2 {
nationality.* x9 O, M6 ?4 d: G, N, y' a
Article 3
1 z  w3 T5 d7 }& [' y: P0 c- HThe People''s Republic of China does not recognize dual nationality for any. @1 D3 ?' U5 ~% {' z% p$ g+ P
Chinese national.
" k( k8 ^. H# v' s; Z: V2 _0 f* bArticle 4
1 _7 b7 _: m# N3 sAny person born in China whose parents are both Chinese nationals  or  one% H1 B# ~1 l. R9 z3 ?3 F
of whose parents is a Chinese national shall have Chinese nationality.
1 J* E1 w1 Z( n1 {Article 5
# b, i% B- V2 f1 K$ }. HAny person born abroad whose parents are both Chinese nationals or one  of
4 m% l# M" t0 m& ?# xwhose parents is a Chinese national shall have Chinese nationality. But  a
' t, U- h1 A$ \1 ~/ P3 r5 eperson whose parents are both Chinese  nationals  and  have  both  settled3 P, A( P3 c; b1 v) `0 d/ }. c
abroad, or one of whose parents is a  Chinese  national  and  has  settled$ ]5 b/ k- h, \7 y  t/ E0 \7 _
abroad, and who has acquired foreign nationality at birth shall  not  have
4 ]* ~4 ^' w/ ^/ v9 vChinese nationality.
- B5 v& _3 w+ o$ }  v! W/ iArticle 6$ O, m# T, O* y' c% z
Any person born in China whose  parents  are  stateless  or  of  uncertain/ {( x3 r6 D  q5 A
nationality and have settled in China shall have Chinese nationality.

. V7 ^1 A( {2 b1 S+ wForeign nationals or stateless persons who are willing to abide by China''s: A9 X' Z5 H5 U) J( b3 K
Constitution and laws and who meet one of the following conditions may  be9 m: h& w8 T5 ^3 h4 l
naturalized upon approval of their applications:
- i# Z2 k9 E; `(1) they are near relatives of Chinese nationals;
, N; r3 F4 \# A0 g/ V' _6 v! ](2) they have settled in China; or
9 v2 m. H% ]& b7 z; U1 i6 P; M(3) they have other legitimate reasons.$ B7 {4 ~5 r" j7 `& I+ g0 E
Article 8% t6 E) p) w, [4 A
Any person who applies for naturalization  as  a  Chinese  national  shall
) H! I1 e- P, ~, Oacquire Chinese nationality upon approval of  his  application;  a  person) s/ c" [* U( ^7 g% Q! L
whose application for  naturalization  as  a  Chinese  national  has  been% V' w1 U- P% |! x( y& n8 e% F$ M6 [# j
approved shall not retain foreign nationality.
8 U& }$ u( H- j0 Z4 K( ^# h8 l* KArticle 9
" \2 l6 E" V  f: K+ ~3 c3 FAny Chinese national who has settled abroad and who has  been  naturalized
$ H. @5 q9 e# {as a foreign national or has acquired foreign nationality of his own  free
% K: z7 y: K: x$ \- q. s8 I7 [# Nwill shall automatically lose Chinese nationality., e. \8 s+ [2 Y# W% e+ @6 Y
Article 109 y2 Z& {, S) q- ~. R# m6 N
Chinese nationals who meet one of the following  conditions  may  renounce, P$ Y! Z) Y. h- A5 |6 o, _
Chinese nationality upon approval of their applications:
3 v! @! l. S' ?8 h! H(1) they are near relatives of foreign nationals;4 |: H( C" S# v! R! B+ E2 a/ S
(2) they have settled abroad; or
) g; N, a0 b' }4 F/ k$ [1 _/ V(3) they have other legitimate reasons.) d1 I1 V: v- |9 V
Article 11& o, n" e5 I) c
Any person who applies for renunciation of Chinese nationality shall  lose7 X; ^- d6 y1 m: p9 ^+ o1 l
Chinese nationality upon approval of his application.
8 Z, \( O$ e7 e/ ]: W5 N: X( cArticle 129 \7 ~' X% W' n3 @0 [# H% j
State functionaries and military personnel on  active  service  shall  not2 B9 [! d6 O4 H1 G! J
renounce Chinese nationality.
% z& f" ^3 f2 c' o8 }: o. L  |6 kArticle 13
7 f' r% ?( ^- v% LForeign  nationals  who  once  held  Chinese  nationality  may  apply  for+ t/ @& {* K4 E5 }! o
restoration of Chinese nationality if they have legitimate reasons;  those
; Q1 s, W- ]( y- U* iwhose applications  for  restoration  of  Chinese  nationality  have  been
' S3 n4 K2 A8 `: K) fapproved shall not retain foreign nationality.0 h6 J# A6 D% N: f- c
Article 14
# m& d; s! z; h0 sPersons who wish to acquire, renounce or restore Chinese nationality, with# f8 Q8 R0 h# E. x
the exception of the cases provided for in Article 9, shall go through the* P! G0 r) s" u) I  n1 H  y) H
formalities of application.  Applications of persons under the age  of  18
4 c6 ^$ v( Q  m9 {- G5 Imay  be  filed  on  their  behalf  by  their  parents   or   other   legal
& s! x! s* f0 Z: Lrepresentatives.7 I; ^- g. L$ B
Article 15
- m" @" H* o8 z/ ^) T5 s9 v* r' \) hNationality applications at home shall be handled by the  public  security
+ n  M9 `3 @9 s6 Cbureaus of the municipalities or counties where the applicants reside;" ~1 k% C6 m/ w: m9 @
nationality applications abroad shall be  handled  by  China''s  diplomatic4 u5 C/ I% U/ q' n. e  _
representative agencies and consular offices.; c! J* p$ H" C$ c' S
Article 16! t# K9 r* X2 ?  v* [# ?" g, ?1 e5 M
Applications for naturalization as Chinese nationals and for  renunciation% [# L2 j% j9 h' j6 U/ c
or restoration of Chinese  nationality  are  subject  to  examination  and
( l" S" B+ D" |8 {  r) ^% qapproval by the Ministry of Public Security of the  People''s  Republic  of
3 o( B$ J; d/ ^- P& j) Y9 IChina. The Ministry of Public Security shall issue a  certificate  to  any) E: [6 I3 m/ U- U* C! S( U8 @
person whose application has been approved.
! ^3 s; r5 m# f+ `: \- aArticle 17
: h7 {( b2 t8 m1 T# M  j/ KThe nationality status of  persons  who  have  acquired  or  lost  Chinese- a, V/ B, k# {* h* e9 O
nationality before the promulgation of this Law shall remain valid.3 X$ T( G* l1 b3 [6 h
Article 18) |" l( y$ k' r/ g( W
This Law shall come into force on the day of its promulgation.
