0 T3 l- i  H* [/ F0 _$ y 第一条   中华人民共和国国籍的取得、丧失和恢复,都适用本法。7 `0 v4 G% |9 \3 N6 \
    第二条   中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。+ r: |% P- e( C' r5 v
    第三条    中华人民共和国不承认中国公民具有双重国籍。5 I/ y- Y0 y( n5 f* u0 I" Y( T
    第四条   父母双方或一方为中国公民,本人出生在中国,具有中国国籍。$ y' [+ ~9 h$ S* Q
    第五条   父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。
8 F( t# u: X3 P& L; r) G    第六条   父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。9 n7 f; ~& M2 }3 b" E: J" x( T
    第七条   外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:9 ]8 e# ?$ o9 G
    一、中国人的近亲属;9 x4 r5 ]3 e2 I! ~; J, l$ P
    二、定居在中国的;! ]% S0 x- B$ y. o3 A$ _1 g
    三、有其它正当理由。
( q: a0 t6 U: W5 f* m    第八条   申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。
# b0 X" b, I! `) F    第九条    定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。+ A9 F% |' v* f1 v- V) c8 a# F
    第十条    中国公民具有下列条件之一的,可以经申请批准退出中国国籍:
# s$ Z% ^6 U: w: l; x( c# j    一、外国人的近亲属;+ t9 y! i6 c. R6 a" t& P
    二、定居在外国的;
' M3 L1 _$ l6 e    三、有其它正当理由。0 Y' v, z: j( z5 u/ i& m
    第十一条    申请退出中国国籍获得批准的,即丧失中国国籍。- @5 Q% M& }' ~; R( E9 o9 F
    第十二条   国家工作人员和现役军人,不得退出中国国籍。2 |4 b8 k) O$ \+ v* {0 G; A
    第十三条   曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。
  t' |7 [# [. k    第十四条   中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。5 M8 [( m( S% A8 R3 z# W
    第十五条    受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。
  j# W3 A3 a6 p5 {) p5 f. A) k    第十六条   加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。
+ y/ R7 ]! r5 @3 {! [    第十七条   本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。0 ?# t! O% D& A- x
    第十八条   本法自公布之日起施行。+ N' q& i' j" e0 b2 G' D

Committee of the  National  People''s  Congress  on  and  effective  as  of

Article 15 Z" z; p2 K' b& M( m; `
This Law is  applicable  to  the  acquisition,  loss  and  restoration  of3 R' y" w" i) A, @" I: q
nationality of the People''s Republic of China." L; h% j4 e0 ~$ S6 C
Article 2
$ [. z0 T+ a, g3 Q5 `9 BThe People''s Republic of China is a unitary multinational  state;  persons9 u9 p$ x; z% `; h7 v+ Q
belonging to  any  of  the  nationalities  in  China  shall  have  Chinese
: v  q1 W& B! U' ?9 rnationality.

The People''s Republic of China does not recognize dual nationality for any
& b7 Z/ V5 r  N$ W5 Q( }3 x5 {Chinese national.4 u0 B2 l1 J  q* n, W5 ]
Article 4
8 |( T1 a0 }9 GAny person born in China whose parents are both Chinese nationals  or  one
  g7 S) T; O6 s' C+ R; xof whose parents is a Chinese national shall have Chinese nationality.$ S, B7 {3 j& _! o# a" Q3 o
Article 5+ {' m" m4 _, Q+ D
Any person born abroad whose parents are both Chinese nationals or one  of
' j4 O4 s* x0 o. c0 Dwhose parents is a Chinese national shall have Chinese nationality. But  a
& E6 j$ M4 J0 L9 Q9 D0 mperson whose parents are both Chinese  nationals  and  have  both  settled
7 Q" y/ f: t5 ]abroad, or one of whose parents is a  Chinese  national  and  has  settled: a+ g$ O5 \  B" c
abroad, and who has acquired foreign nationality at birth shall  not  have
7 {0 R! l# K7 }; T2 u+ T* R  e5 HChinese nationality.
: ]; N" o3 N, N/ K  XArticle 65 V, n  x& o  L& @0 x! [
Any person born in China whose  parents  are  stateless  or  of  uncertain
7 [# L. V4 G- H6 O! t6 hnationality and have settled in China shall have Chinese nationality.0 I* v; ?6 c5 J9 d
Article 76 N3 m2 o9 G! F
Foreign nationals or stateless persons who are willing to abide by China''s: |6 z% _  ^# Y! ~, _8 X# E
Constitution and laws and who meet one of the following conditions may  be
# F  x4 J+ w* r& {9 A' I4 i. d9 Pnaturalized upon approval of their applications:
" e+ z6 t5 H+ s' o: N(1) they are near relatives of Chinese nationals;! i9 X& g0 ?$ ^! P: E8 i; y
(2) they have settled in China; or& c. |. V1 Y" I- y. E- p
(3) they have other legitimate reasons.( p% p4 l' v2 z, q7 ]* s, x. \
Article 8
9 m* W$ K9 T0 t4 }# D9 e  D- ~Any person who applies for naturalization  as  a  Chinese  national  shall2 z" c) D: v) Y
acquire Chinese nationality upon approval of  his  application;  a  person- l: Z: _! |! D
whose application for  naturalization  as  a  Chinese  national  has  been
+ A/ P4 k; v6 i* |5 @& vapproved shall not retain foreign nationality.
8 w. S! b8 k) j) X5 [Article 9) y$ T1 _( z. m2 _( k" l3 p
Any Chinese national who has settled abroad and who has  been  naturalized( \$ j5 j/ a. ?8 |: Z8 C8 |
as a foreign national or has acquired foreign nationality of his own  free
& v' b6 ^& X2 @6 a1 K% Uwill shall automatically lose Chinese nationality.
8 y& b+ H6 R& v: q( n  U* Y3 mArticle 10* e% B. i1 P- U
Chinese nationals who meet one of the following  conditions  may  renounce
( O* B# _+ T( c, y+ eChinese nationality upon approval of their applications:! n# s  z# f  W4 Q7 }. ]- }- I
(1) they are near relatives of foreign nationals;# r2 E3 J) i! X4 \" H* R  Z, s
(2) they have settled abroad; or/ Q3 {  L& G! A; X* \
(3) they have other legitimate reasons.- Z  o% _2 G6 K
Article 11
% @5 l: E/ Y- Z3 J& x7 u# v+ o/ G: EAny person who applies for renunciation of Chinese nationality shall  lose* Z2 `- r7 z) r) `: i- g
Chinese nationality upon approval of his application.
( I0 m& V# W2 w6 B* A, o5 @" qArticle 12
6 V1 |' J' g! O3 T: b5 ^9 x1 y5 j. g* fState functionaries and military personnel on  active  service  shall  not
1 Z, M! J9 P& }( Krenounce Chinese nationality.
: b1 m' C4 k+ b, m& Z+ K* h  AArticle 13
1 o( n5 d; ?/ [' u9 _: N/ m( ~Foreign  nationals  who  once  held  Chinese  nationality  may  apply  for! n3 T( J2 o$ o& [9 A
restoration of Chinese nationality if they have legitimate reasons;  those4 `* y, ~: R" u9 X3 E& a
whose applications  for  restoration  of  Chinese  nationality  have  been; g( x0 M0 f) g' U
approved shall not retain foreign nationality.
9 A7 I  _( |  a& C+ Q3 LArticle 14
0 C! `" P( v' O$ O; u* r$ P4 L. Y3 JPersons who wish to acquire, renounce or restore Chinese nationality, with* W( P8 @5 n+ \: }! q. J
the exception of the cases provided for in Article 9, shall go through the
0 G7 n: b; L! ]" n9 Aformalities of application.  Applications of persons under the age  of  18* A- B. B( ~9 c9 [0 J
may  be  filed  on  their  behalf  by  their  parents   or   other   legal# m. a' c: x% Q4 a0 @) j, ]
representatives.
) E/ f9 @; c* p) o$ c* }- MArticle 15
+ N3 {. g/ p. u8 c0 a' d1 E4 r5 c) ~Nationality applications at home shall be handled by the  public  security/ T0 G6 y" F# ^  S% G3 v0 h* @
bureaus of the municipalities or counties where the applicants reside;6 D  F! y: B7 I; q) {) X7 H% g) K
nationality applications abroad shall be  handled  by  China''s  diplomatic  c+ T: T& K6 N7 a, i. T$ m
representative agencies and consular offices.* g4 l, F' M% ?5 n2 g% `. _" x# {- j2 E
Article 16
1 ?5 G) W) {2 @Applications for naturalization as Chinese nationals and for  renunciation3 h8 E% b% \1 o5 C  V% k8 Q% A
or restoration of Chinese  nationality  are  subject  to  examination  and
8 W+ L5 @; c+ g! @, Z& }& gapproval by the Ministry of Public Security of the  People''s  Republic  of. [9 g% |' l7 Y+ s+ ^  D
China. The Ministry of Public Security shall issue a  certificate  to  any9 n) v) |5 O; k9 u# T2 f
person whose application has been approved." G! s( r$ k. A( [  w
Article 17
3 ~& [! c# D& R2 OThe nationality status of  persons  who  have  acquired  or  lost  Chinese
; w% G) n+ k) W: [+ A* f+ Mnationality before the promulgation of this Law shall remain valid.
; Q/ c/ N! C8 _7 F6 iArticle 18. z6 K9 O/ c3 R6 K: x
This Law shall come into force on the day of its promulgation.
