第一条 中华人民共和国国籍的取得、丧失和恢复,都适用本法。& r, n$ ?" `7 t( \3 c5 k/ b# N
第二条 中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。( u4 ?. m- A& K) D6 S% O
第三条 中华人民共和国不承认中国公民具有双重国籍。5 P4 Q7 T- \1 j; l6 x$ L# o
第四条 父母双方或一方为中国公民,本人出生在中国,具有中国国籍。
8 P3 g. D9 q+ d9 u$ ~( p8 y* |# M 第五条 父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。

一、中国人的近亲属;

三、有其它正当理由。

第九条 定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。
2 t q6 ^9 F$ D9 T- F4 S 第十条 中国公民具有下列条件之一的,可以经申请批准退出中国国籍:

第十一条 申请退出中国国籍获得批准的,即丧失中国国籍。% t" `5 p' D3 p5 G
第十二条 国家工作人员和现役军人,不得退出中国国籍。* F* b2 f; z& @
第十三条 曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。4 [* g. ?: @: |$ E2 c
第十四条 中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。0 s/ m2 H- Y7 {8 j7 B' G; x
第十五条 受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。9 k' J6 d; x. K# H
第十六条 加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。

whose parents is a Chinese national shall have Chinese nationality. But a

Foreign nationals or stateless persons who are willing to abide by China''s" B, X0 S. u, S: n
Constitution and laws and who meet one of the following conditions may be9 f4 ~7 k$ l N4 ~; G
naturalized upon approval of their applications:
l! k% L3 }& m0 j5 Q) r(1) they are near relatives of Chinese nationals;+ n; j9 K9 _' W7 F: I! V+ S4 ~+ o
(2) they have settled in China; or
& W3 K. r) U2 c" g0 c _8 z: b) ~(3) they have other legitimate reasons.

acquire Chinese nationality upon approval of his application; a person

Any Chinese national who has settled abroad and who has been naturalized S9 @: _0 I7 J
as a foreign national or has acquired foreign nationality of his own free

Chinese nationals who meet one of the following conditions may renounce% Z: o) w" a# o8 d9 l% X. p
Chinese nationality upon approval of their applications:- i2 z$ ], {( d' l" H/ a' i
(1) they are near relatives of foreign nationals;9 |' y8 g9 K/ \4 Q; w2 B, q
(2) they have settled abroad; or8 x; |+ a9 M5 r1 }$ B- l% m1 G& T
(3) they have other legitimate reasons.

- x: o9 M A6 g4 \0 DAny person who applies for renunciation of Chinese nationality shall lose
8 D; m# I6 x$ P' A" lChinese nationality upon approval of his application.

State functionaries and military personnel on active service shall not; y2 c6 Q5 {2 m5 l9 ^1 k+ d
renounce Chinese nationality.

% D3 Z% ?' H& ^0 H# i# q# rForeign nationals who once held Chinese nationality may apply for4 {3 i9 w' l t1 B6 w8 w
restoration of Chinese nationality if they have legitimate reasons; those

Article 14
; j& D: c/ @3 v) W5 W4 FPersons who wish to acquire, renounce or restore Chinese nationality, with
[: M) o8 I8 e7 Mthe exception of the cases provided for in Article 9, shall go through the
9 w) o# }( u- W# S+ a/ r# y1 pformalities of application. Applications of persons under the age of 18
& K3 w, ^9 N/ Ymay be filed on their behalf by their parents or other legal
& d( u1 n- E0 A/ I! v6 vrepresentatives.& g {0 t; B! k6 ^
Article 15+ P( F1 l, D2 M9 ], H5 g
Nationality applications at home shall be handled by the public security- Q5 R" j S/ x5 J5 C. ~. g6 N
bureaus of the municipalities or counties where the applicants reside;! T7 y' Z# F5 A% ?
nationality applications abroad shall be handled by China''s diplomatic; v$ j& j* \! {6 O' A# d: C. e
representative agencies and consular offices.( q4 B3 r: c1 Z& D
Article 16- E" z3 X( W; K
Applications for naturalization as Chinese nationals and for renunciation
2 P' I! \8 M( {9 H/ Q+ x3 A/ For restoration of Chinese nationality are subject to examination and
! Z$ z% E% [2 F4 i* O( Lapproval by the Ministry of Public Security of the People''s Republic of
. a2 e6 a( Q' u$ w4 Q% q# i3 \China. The Ministry of Public Security shall issue a certificate to any
5 m$ [: K/ X9 y2 L& ~/ \3 w! Jperson whose application has been approved.

The nationality status of persons who have acquired or lost Chinese
3 J4 z: K; [+ x2 H5 Pnationality before the promulgation of this Law shall remain valid.9 e- g( n. z- M% `
Article 18, L9 A8 M1 G- s, |# e1 C! O
This Law shall come into force on the day of its promulgation. |
