Q0 O' w: |8 V2 F" O$ s 第一条 中华人民共和国国籍的取得、丧失和恢复,都适用本法。" J U- j1 H( z
第二条 中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。
% r9 ~9 n" A# n, J- h$ `8 f 第三条 中华人民共和国不承认中国公民具有双重国籍。/ I7 b4 X+ R6 M8 @4 G
第四条 父母双方或一方为中国公民,本人出生在中国,具有中国国籍。2 I' U) z5 I+ J
第五条 父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。. n0 z+ r ?4 X6 f) |3 f( ]
第六条 父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。2 n. ?/ k7 c1 N) v8 g
第七条 外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:+ f# r* r3 u" s" B! X7 Y
一、中国人的近亲属;% \5 e! |; N3 z. N+ |7 K
二、定居在中国的;

第八条 申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。
& i6 v) h! x) Y' O- b4 F& w" n 第九条 定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。! I% |& A0 Z6 j, u5 u$ q
第十条 中国公民具有下列条件之一的,可以经申请批准退出中国国籍:/ q7 o3 G- v' M9 L4 e. k5 i% e
一、外国人的近亲属;& g2 K: M/ @0 P* i, @" t0 K
二、定居在外国的;

. G9 p: E# C" S o$ B/ Y 第十一条 申请退出中国国籍获得批准的,即丧失中国国籍。
$ _" \7 f3 s3 f0 g# D 第十二条 国家工作人员和现役军人,不得退出中国国籍。
; Y& z/ I' D4 L+ i0 P- g 第十三条 曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。6 `, p3 A* o0 h/ z
第十四条 中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。6 _' G/ z2 [& L4 z% n
第十五条 受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。
/ |1 e& u/ H6 X) a 第十六条 加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。( f1 C0 X& ]& X. |) l5 N1 Z7 K! I
第十七条 本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。

The People''s Republic of China is a unitary multinational state; persons

whose parents is a Chinese national shall have Chinese nationality. But a, Z5 B2 x w9 `2 k: D# u
person whose parents are both Chinese nationals and have both settled2 x5 M4 o7 W7 o& Z
abroad, or one of whose parents is a Chinese national and has settled, q" j7 }4 y7 \" `: X
abroad, and who has acquired foreign nationality at birth shall not have1 [1 G( B$ r' ` O# \
Chinese nationality.

Any person born in China whose parents are stateless or of uncertain

Article 7
+ o* x" P8 M) U1 C( W+ |Foreign nationals or stateless persons who are willing to abide by China''s M) w- M7 g) t3 t, y9 ]% M
Constitution and laws and who meet one of the following conditions may be7 p+ }% L2 Y2 d% I6 Y
naturalized upon approval of their applications:* f$ t$ c& h, {2 h3 h. {
(1) they are near relatives of Chinese nationals;
2 S1 a2 `8 S4 K5 m; v% p) j(2) they have settled in China; or
- M3 O( n8 P* _' v! K! [( ?(3) they have other legitimate reasons.

: b3 I8 @, _0 [$ KAny person who applies for naturalization as a Chinese national shall
$ x9 E# z( R) m* wacquire Chinese nationality upon approval of his application; a person
8 l/ |2 I& n5 H9 b) ~ y& wwhose application for naturalization as a Chinese national has been
' O* X7 {6 k9 _! Y2 u$ O* `approved shall not retain foreign nationality.
' Q# M \' i& yArticle 9/ p: q4 P8 [+ o: Q
Any Chinese national who has settled abroad and who has been naturalized
# G, |: Z5 b+ `9 a6 B5 Z: }as a foreign national or has acquired foreign nationality of his own free
! ~( P( c+ r( F1 p9 `8 l' i l2 cwill shall automatically lose Chinese nationality.

Chinese nationals who meet one of the following conditions may renounce
2 q p8 }, Z0 Y, Z- g& WChinese nationality upon approval of their applications:& D* B: h) k* j0 C6 }; F
(1) they are near relatives of foreign nationals;
) D! u- V, J' W5 U8 A+ _(2) they have settled abroad; or/ u# v! q& h( x% C$ o7 a' Y/ y9 I
(3) they have other legitimate reasons.

Any person who applies for renunciation of Chinese nationality shall lose
9 F H! T4 [+ _& S( |5 N$ n/ WChinese nationality upon approval of his application." H& n- T8 V, o1 A& l# m U
Article 12
, e( O; C: Y# y; }3 ?5 r- nState functionaries and military personnel on active service shall not: L! t5 Z# y9 I2 K$ W+ V$ a
renounce Chinese nationality.# M& h9 o: A- U: j/ F W; H
Article 130 ~, S% ^* R& a
Foreign nationals who once held Chinese nationality may apply for
6 U! N4 G9 n6 {" x, T9 Lrestoration of Chinese nationality if they have legitimate reasons; those
2 i( f1 Q9 N9 v# s Ywhose applications for restoration of Chinese nationality have been; B! b% ]( w/ h6 o
approved shall not retain foreign nationality.) j7 G* i8 \: Y* ~* |
Article 14
, Z/ ?9 `2 ^$ HPersons who wish to acquire, renounce or restore Chinese nationality, with6 Z6 n; D+ [+ o
the exception of the cases provided for in Article 9, shall go through the
' Q! h. m& ]4 j- ^1 a' d! rformalities of application. Applications of persons under the age of 18
3 z. y, N4 u) ]8 A2 n' Q% D$ tmay be filed on their behalf by their parents or other legal
2 X8 u* W) _5 S! f5 r6 Grepresentatives.$ e5 r9 T! y# e c, c" s
Article 15" \# V* C9 Q* ?. g" s/ g) k
Nationality applications at home shall be handled by the public security, v0 a5 c1 u4 A5 S
bureaus of the municipalities or counties where the applicants reside;
& n6 ] Y# c* onationality applications abroad shall be handled by China''s diplomatic
1 M. F# J) M. m* Y8 zrepresentative agencies and consular offices.$ a& ^$ C6 s: U: y1 A2 u
Article 16
/ t4 d! J( E! F& v' J; AApplications for naturalization as Chinese nationals and for renunciation) f2 a0 I: w" u
or restoration of Chinese nationality are subject to examination and
6 I. z2 @1 T2 d, ]2 \; h- @6 `approval by the Ministry of Public Security of the People''s Republic of
' a1 W9 E0 d& j" p% S6 O6 PChina. The Ministry of Public Security shall issue a certificate to any& p8 \. o6 M6 x! m' A6 |
person whose application has been approved.* ?1 e! k6 n" p$ O& |( i0 L# I
Article 17
: B" n) m/ M5 n1 \% x5 wThe nationality status of persons who have acquired or lost Chinese& x4 p& u: G2 y4 O( s9 X e- x
nationality before the promulgation of this Law shall remain valid.
7 N1 V% W7 u" r& w) C7 AArticle 18, o w P( G1 L
This Law shall come into force on the day of its promulgation. |
