《中华人民共和国国籍法》 3 `0 t. \! X2 B* W
2 V0 j9 q ~* k- x" n8 g5 g 第一条 中华人民共和国国籍的取得、丧失和恢复,都适用本法。
& B5 r# }* D" B$ [ 第二条 中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。) ?6 q/ m. {& Z8 \- e# Q
第三条 中华人民共和国不承认中国公民具有双重国籍。8 V/ [+ U& s }/ {- q
第四条 父母双方或一方为中国公民,本人出生在中国,具有中国国籍。1 A. [ b9 y( c/ S
第五条 父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。
9 z( W- A' |" J/ y1 w+ L% L 第六条 父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。
$ j; s. N( l; j7 U b3 `4 J 第七条 外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:

二、定居在中国的;. P8 m5 l0 \/ S$ I! c

第八条 申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。
( }8 }9 s3 ?4 y0 `" x% m 第九条 定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。
9 r. L0 [! j2 _# z @, e/ {' [' J 第十条 中国公民具有下列条件之一的,可以经申请批准退出中国国籍:
8 c4 Y( s# s2 w* |$ [ 一、外国人的近亲属;
6 y( \5 ^5 ` L 二、定居在外国的;" U4 f) O0 h$ s' C9 }5 J
三、有其它正当理由。
+ a/ Z4 D" y) f 第十一条 申请退出中国国籍获得批准的,即丧失中国国籍。: I( T* U7 I% O
第十二条 国家工作人员和现役军人,不得退出中国国籍。! _; Y1 b0 Q ^3 |; Q
第十三条 曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。
) d1 V D9 g0 p% H0 c3 e6 e+ K 第十四条 中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。
0 a# P, B2 p/ \* x9 n4 K 第十五条 受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。
5 u9 v$ ~% F4 h4 G! D! W5 S7 P 第十六条 加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。. ]2 l+ P& e+ C& P6 H5 d
第十七条 本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。* ?# J( r6 n7 O8 r0 Q w

The People''s Republic of China is a unitary multinational state; persons
2 w3 I$ @1 ]8 z! H6 x( ?6 U- H+ abelonging to any of the nationalities in China shall have Chinese, X# A% C5 |6 N5 u, T3 Q
nationality.

The People''s Republic of China does not recognize dual nationality for any

Article 4
4 I+ r2 f8 v" L$ ]: LAny person born in China whose parents are both Chinese nationals or one3 z4 P3 E3 S* c* Q
of whose parents is a Chinese national shall have Chinese nationality.

# q( Z8 J7 C z5 }& awhose parents is a Chinese national shall have Chinese nationality. But a

0 P# S: U% z/ l- S# p2 `& Yabroad, or one of whose parents is a Chinese national and has settled
3 m- L7 p( U( {$ ?9 A0 Z( Uabroad, and who has acquired foreign nationality at birth shall not have

Any person born in China whose parents are stateless or of uncertain
0 C" I o8 ?# r. Znationality and have settled in China shall have Chinese nationality.

Foreign nationals or stateless persons who are willing to abide by China''s
, o. K6 g" a9 NConstitution and laws and who meet one of the following conditions may be
1 _+ Y! ?$ Y. {! ]+ T! J+ n: ^* L& Q5 R: Z3 hnaturalized upon approval of their applications:
$ M4 a" b9 l; J3 ]0 X w" V: P0 o(1) they are near relatives of Chinese nationals;7 r& m' i: V Y! x4 e
(2) they have settled in China; or
7 v/ V0 L7 I) \) }(3) they have other legitimate reasons.' i( o5 T4 Z& k( F. A
Article 8; q; j/ v4 |* `* D' q
Any person who applies for naturalization as a Chinese national shall! s2 u( \2 c+ Y0 a% R7 b
acquire Chinese nationality upon approval of his application; a person
( T6 x+ {6 F. {3 p2 j/ fwhose application for naturalization as a Chinese national has been
% T$ Y9 p# W& Tapproved shall not retain foreign nationality.4 N6 V& j+ N6 U' \
Article 9. L, Q+ B3 n9 b. p, m) W8 n
Any Chinese national who has settled abroad and who has been naturalized; W3 T* x& r- o6 h+ F2 l4 ?* K
as a foreign national or has acquired foreign nationality of his own free. X5 Q6 i4 Y- s: P! P6 w
will shall automatically lose Chinese nationality.
n' h9 d0 B6 D4 ^ tArticle 10, _1 s; R- d( o
Chinese nationals who meet one of the following conditions may renounce* F2 C$ j0 }" {- w1 U
Chinese nationality upon approval of their applications:2 r5 F, W- T1 Q# v+ R, c, ?
(1) they are near relatives of foreign nationals;
. e3 v4 y" J+ C/ |5 w- x6 k U+ P(2) they have settled abroad; or
8 ~( w8 u' M# f4 N! c; t0 V: J# Q$ A(3) they have other legitimate reasons.

" N: Y5 @% z$ d: h/ B% `7 WAny person who applies for renunciation of Chinese nationality shall lose. {+ x6 }. n$ ?* k% S7 Z
Chinese nationality upon approval of his application.

State functionaries and military personnel on active service shall not A" Y3 X2 t4 w& f6 Q6 M% b" Z
renounce Chinese nationality.

Foreign nationals who once held Chinese nationality may apply for& l: S! H* H8 b, H `/ @4 c
restoration of Chinese nationality if they have legitimate reasons; those
- \7 a' D9 b |3 n( ]* N. `& c: I. swhose applications for restoration of Chinese nationality have been4 {/ A2 O! s9 Z% p+ _
approved shall not retain foreign nationality.
8 e3 x: y6 p1 \3 s; nArticle 14, B' C& p) I2 L8 m" z
Persons who wish to acquire, renounce or restore Chinese nationality, with
* x# [* n& A6 C/ R+ A a6 E3 othe exception of the cases provided for in Article 9, shall go through the
/ l5 q) z# P1 qformalities of application. Applications of persons under the age of 18
- L2 I$ i5 ^9 x/ B# B- {# c* vmay be filed on their behalf by their parents or other legal
/ c# c3 m, \: q3 Q' `0 `. Erepresentatives.
$ Q1 A, j6 s$ X5 o6 F) g" ~Article 15! Z, X6 r4 Z* b4 l( O' {3 p: Z' N
Nationality applications at home shall be handled by the public security7 X6 T4 F @. W% D, f! e8 {
bureaus of the municipalities or counties where the applicants reside;
' O& Q6 T3 C: S' k9 lnationality applications abroad shall be handled by China''s diplomatic
9 K! [0 W8 l7 e% \" e! l; Drepresentative agencies and consular offices.

Applications for naturalization as Chinese nationals and for renunciation
; M/ ]6 L; d$ ~* Y: cor restoration of Chinese nationality are subject to examination and4 [4 ~: o1 R9 d2 _
approval by the Ministry of Public Security of the People''s Republic of
6 V$ u) V8 h; }8 ] u* @7 a' xChina. The Ministry of Public Security shall issue a certificate to any
* e5 Q$ t5 X8 `5 [# l$ X# Vperson whose application has been approved.; g p; \5 t: {7 j2 @5 k
Article 17
, O5 F# u2 B) [5 A! r$ FThe nationality status of persons who have acquired or lost Chinese
. M$ m5 g% V; r- A( Mnationality before the promulgation of this Law shall remain valid.3 @- Y& m. b9 T2 w. B5 ]" w
Article 18
" K# ]% P! Z1 {. mThis Law shall come into force on the day of its promulgation. |
