Insurance required

Except as otherwise permitted under this Act, a person shall! H& b/ |" c& g2 F& O8 p
not do any of the following:+ z# e6 H8 w9 [9 N3 h1 n
(a) drive a motor vehicle on a highway unless the motor
9 g$ f& R9 x& i* nvehicle is an insured motor vehicle;; }/ j: j2 Y9 }7 Z; e. B
(b) have a motor vehicle on a highway unless the motor' `& r2 |8 t4 `
vehicle is an insured motor vehicle;6 A# m$ r4 T4 s I6 {1 T& b6 ] w6 ]
(c) where a person is the registered owner of a motor vehicle,
0 E5 [( Z7 e* qpermit another person
& [; O; @4 t) p1 W; J(i) to drive the motor vehicle on a highway, or
# Z8 \! d; d' l# ~1 a" \(ii) to have the motor vehicle on a highway,
. L6 J. ?9 Y% w6 V+ Gunless the motor vehicle is an insured motor vehicle;
k5 R7 m. U* o4 A& S(d) give or lend a financial |! i8 q g2 Q H- [
responsibility card or a copy of it+ y3 g: C" N2 E9 u/ y; n& h
to a person not entitled to have that financial
" }- E, X+ K) `9 V: `. C+ kresponsibility card or copy.$ D2 C6 T, |0 P( K) `- N

If a person drives or has a motor vehicle on a highway6 D3 S c1 k& E/ h- y, w
without the expressed or implied consent of the registered owner of3 y7 \+ @$ w2 C! Z& M0 r/ u% L
the vehicle, that person is deemed for the purposes of subsection
) f Z) K7 L+ g(1)(a) or (b) to drive or have on a highway a motor vehicle that is
( z. B$ E; ?- ?0 |' xnot an insured motor vehicle.
* \& V P2 J; H; o(2)+ ]6 u; t. x& d
If the registration of a motor vehicle is suspended under this) u; Q9 i6 D( D8 a1 X' H
Act, the motor vehicle is still registered for the purposes of this
& Q# ?9 ~# W+ e3 X4 qsection.+ a* j* H9 M' i* C

. E! D' ^: p& B7 I+ Q% u' \4 ^) ESubsection (1)(a) and (b) do not apply to a person to whom a3 f' w5 u' k P5 Y4 d: @9 i
financial responsibility card has been issued pursuant to the
/ d* K& |$ p; L% DInsurance Act
, d( e9 _# F% Y) |by an insurer who has issued an owner’s policy/ k9 e6 y+ @ g+ g H# i8 x
outside Alberta.
! s* F; |/ Q& T# c' h" b$ q(4)0 _( ^% U5 _% \6 S5 D8 }9 l
A person, other than a corporation, who contravenes subsection
; s% j' p7 h, W! U2 p(1) or section 52(1)(h) or 167(8) is liable,- _! L& M7 Z4 ?& I$ \
(a) for the first contravention, to a fine of not less than $2500
' `0 e! o: \1 vand not more than $10 000 and in default of payment to
. Y- w% J4 f l% I7 M; Cimprisonment for a term of not less than 45 days and not
6 d' Z) F/ s( `more than 6 months
! ~$ h$ V9 b# A
& m: z* Z' ~1 F5 P) B, v4 N1 v1 R3 {Minimum $2500, if you don't pay, you will go to jail for a minimum of 45 days. |
