《中华人民共和国国籍法》
* W, `* G$ F: n  1 ~# d9 W* [4 v' K
第一条   中华人民共和国国籍的取得、丧失和恢复,都适用本法。
' L3 z4 U6 D3 E" |9 Z# d    第二条   中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。
3 g1 d  T# u* B! S1 z( N; _2 f    第三条    中华人民共和国不承认中国公民具有双重国籍。0 M1 T! N9 M! l9 X% W5 N4 W
    第四条   父母双方或一方为中国公民,本人出生在中国,具有中国国籍。' F: H  U. Q/ n% O" N# e2 _( ]
    第五条   父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。* Z4 C" I: K, H& e9 H  @
    第六条   父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。
2 k. f( b- }! x2 d& n! ]* I7 {8 V4 I    第七条   外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:
% d* m0 m  c# _* G# z5 B% M    一、中国人的近亲属;
9 [. S& \7 q/ B    二、定居在中国的;
+ l5 B3 {! \# I. ]: k& L1 e4 c2 o    三、有其它正当理由。; v8 p/ K! n% a
    第八条   申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。: n3 h, Y& d8 p' v, B+ p5 y/ O
    第九条    定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。
7 ]) J: y7 y8 Y5 ?9 P0 f+ `    第十条    中国公民具有下列条件之一的,可以经申请批准退出中国国籍:
8 ^+ _/ b) y4 z    一、外国人的近亲属;1 J7 R8 Q# \0 n/ A7 f7 d
    二、定居在外国的;) g2 k$ _4 y/ J. M9 ]* ~" z
    三、有其它正当理由。
  B) o. {0 r% c% t6 Z& ~4 {% L    第十一条    申请退出中国国籍获得批准的,即丧失中国国籍。
2 i0 Z& _* J- h  g/ T    第十二条   国家工作人员和现役军人,不得退出中国国籍。. C5 t) ?; Q. H! m: P  e
    第十三条   曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。
; n( S+ v3 ^5 I% u, X1 }) V    第十四条   中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。5 r, e& X3 c- T
    第十五条    受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。/ F4 b) Q1 o) t( Z" F1 X) H4 _
    第十六条   加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。
& {( _+ k) g3 g0 T    第十七条   本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。4 x% T& T9 `- X: ~2 d
    第十八条   本法自公布之日起施行。' {0 ]; t) h% ^2 _

1 B, J; k3 V8 }; X* S- ACommittee of the  National  People''s  Congress  on  and  effective  as  of

Article 1
2 ~: Z# Z3 N  s% [# q/ ]4 C: TThis Law is  applicable  to  the  acquisition,  loss  and  restoration  of
0 \% a- Y3 P. m0 b' _& O3 n% [2 Wnationality of the People''s Republic of China.
! N, L# \: r# j% |- B! M; Z' ^. N$ {Article 2# F1 W6 E9 V7 \( {7 `/ ^
The People''s Republic of China is a unitary multinational  state;  persons0 @7 s6 V+ `6 t' I* ]# `
belonging to  any  of  the  nationalities  in  China  shall  have  Chinese
# l. w3 |8 q; D# a% \3 |nationality.- l- {( T9 q8 q
Article 37 a( `, r; Y* q$ b: X* I
The People''s Republic of China does not recognize dual nationality for any
% @. u8 b, v, u7 O/ `9 W5 zChinese national.
8 {( @( k. _% D) y6 eArticle 4
$ D6 Y2 B) q( C5 _7 N3 `Any person born in China whose parents are both Chinese nationals  or  one4 m% z1 j& [, Y0 p8 H6 |+ l
of whose parents is a Chinese national shall have Chinese nationality., I" j$ y2 H- `
Article 52 k5 J0 @/ R1 H" u: H6 T2 i
Any person born abroad whose parents are both Chinese nationals or one  of
( m2 M$ {% s0 K; P6 @- Xwhose parents is a Chinese national shall have Chinese nationality. But  a
3 @* v% I9 r$ a  |person whose parents are both Chinese  nationals  and  have  both  settled
; j1 u/ _+ j! U0 C* W" R9 Nabroad, or one of whose parents is a  Chinese  national  and  has  settled) K# y8 J9 {+ [  |4 D# \. g
abroad, and who has acquired foreign nationality at birth shall  not  have  }2 a5 Q! m( [$ p
Chinese nationality.
- A  i4 ~, }; I( `. @' m- z% I" v# ]5 SArticle 6
# o; }( e  I: R% E" w# jAny person born in China whose  parents  are  stateless  or  of  uncertain4 f" K1 s' F. w9 K/ Q) ^
nationality and have settled in China shall have Chinese nationality.
1 k4 c8 b$ Z+ x+ P; t% uArticle 7' Y' W! e) A/ r  G" w
Foreign nationals or stateless persons who are willing to abide by China''s. P2 B3 m2 M. @, x/ D
Constitution and laws and who meet one of the following conditions may  be
5 k; q; C/ I% s+ |+ Pnaturalized upon approval of their applications:
. R! @8 Y# z9 S3 H9 c(1) they are near relatives of Chinese nationals;
3 C% I% Q$ I* S) z2 l7 F5 n8 {(2) they have settled in China; or
& N' [- u: o' K  e0 ?9 I(3) they have other legitimate reasons.5 m& h0 t; x/ i- f6 x7 t
Article 89 _+ k) w1 d- G$ {
Any person who applies for naturalization  as  a  Chinese  national  shall
( K) I$ C  O' _  g+ ~* H4 xacquire Chinese nationality upon approval of  his  application;  a  person# z* ]' l: m1 ?4 \# h, A- S8 p
whose application for  naturalization  as  a  Chinese  national  has  been
/ Q$ C1 Q8 X+ H/ r4 R* c- @1 sapproved shall not retain foreign nationality., {$ L: f. D+ ~
Article 9
( r6 y% w0 m) D. JAny Chinese national who has settled abroad and who has  been  naturalized$ v  f5 W6 z. _) w4 B
as a foreign national or has acquired foreign nationality of his own  free; z& K) N5 i6 |2 R* j1 C
will shall automatically lose Chinese nationality.
: P: X$ c6 d$ P7 Q+ `Article 10
& I, k+ L7 L' }5 {/ [- mChinese nationals who meet one of the following  conditions  may  renounce2 e+ g9 _) y; m4 e7 T9 R+ p
Chinese nationality upon approval of their applications:% |3 A- @0 p- [* b& P* y6 ~% [
(1) they are near relatives of foreign nationals;  I9 A6 T  d. e* c$ \1 q
(2) they have settled abroad; or# `' ]6 e- D1 q9 |) l: g& q6 V# o( Q
(3) they have other legitimate reasons.7 `* o# h- E' G/ V
Article 113 d( Z8 h) c) i: p" i0 s
Any person who applies for renunciation of Chinese nationality shall  lose
) k: R, @" s/ J* ~4 v) h. @Chinese nationality upon approval of his application.
6 T6 D" }1 w* {5 o8 _/ ZArticle 12
% e- s7 ^1 G( W$ f  ]! N6 NState functionaries and military personnel on  active  service  shall  not; n) D9 n$ Z( A+ E% S2 U1 s* b
renounce Chinese nationality.
& {6 V6 i  D# u9 PArticle 13; k! r) s) Q0 p& I% B
Foreign  nationals  who  once  held  Chinese  nationality  may  apply  for8 t) C  A" N! I2 l( X, P1 H  w
restoration of Chinese nationality if they have legitimate reasons;  those
0 U  M* P# }4 ]7 N/ E: C+ ywhose applications  for  restoration  of  Chinese  nationality  have  been  u% Q3 e$ J1 I' k- R
approved shall not retain foreign nationality.+ N% A; O1 R8 _6 P1 ]$ r
Article 14
8 P  H2 y3 W; fPersons who wish to acquire, renounce or restore Chinese nationality, with
/ z" }. J( K5 a: ?the exception of the cases provided for in Article 9, shall go through the
, F' V; z1 W& t1 j3 tformalities of application.  Applications of persons under the age  of  18
2 ]- I" F' ^. a9 B% \may  be  filed  on  their  behalf  by  their  parents   or   other   legal
9 x  ~8 b3 i/ b8 ]- drepresentatives.. {1 I! {# c( M$ ~% G
Article 15
1 M5 E' ^2 Y% U6 hNationality applications at home shall be handled by the  public  security
# g7 W4 H9 S. U+ B5 `  l. xbureaus of the municipalities or counties where the applicants reside;" @! U! g  @# x, _4 \7 ]0 M
nationality applications abroad shall be  handled  by  China''s  diplomatic+ [: o2 R0 M+ D4 x+ Z; r
representative agencies and consular offices." S( S: U, M( k
Article 16
8 M1 E! F- `8 yApplications for naturalization as Chinese nationals and for  renunciation
, [9 }4 B: V( W, g( O" o+ |or restoration of Chinese  nationality  are  subject  to  examination  and! u7 S: L' e- X2 ]
approval by the Ministry of Public Security of the  People''s  Republic  of- z: _+ J* g2 B  o( ]( C  ]0 R
China. The Ministry of Public Security shall issue a  certificate  to  any2 O  N: ^% X- L. b! D
person whose application has been approved.
8 C: r& V3 A* ]- r7 IArticle 17/ z) ~2 c# [/ p$ a2 ~
The nationality status of  persons  who  have  acquired  or  lost  Chinese: V+ F$ [. J( L
nationality before the promulgation of this Law shall remain valid.
! D' {3 A* P( R+ p+ ^Article 18" v' a" u% O& L2 C, X! N4 _% I
This Law shall come into force on the day of its promulgation.
