第一条 中华人民共和国国籍的取得、丧失和恢复,都适用本法。
1 D3 \$ V# j! s2 M X- ]3 l$ j* p 第二条 中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。4 u( U W0 s( j# i$ E0 z
第三条 中华人民共和国不承认中国公民具有双重国籍。
) y0 N, K, N0 N0 h5 N 第四条 父母双方或一方为中国公民,本人出生在中国,具有中国国籍。/ l0 ?/ E# h6 c% n
第五条 父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。
" K% {# Y" J" N% F 第六条 父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。
' S- S: e. h) d# Q2 k 第七条 外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:
* V2 `& K, ]9 p, } 一、中国人的近亲属;
$ M% H; ~0 f/ l `- P 二、定居在中国的;
; k7 y+ _* b+ q# }! @ 三、有其它正当理由。9 H( x! t" c; A' ?5 d% k
第八条 申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。
# s* K7 A6 ? K0 j' t8 }# C+ _ 第九条 定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。3 A& f+ Y. t! E' @ S
第十条 中国公民具有下列条件之一的,可以经申请批准退出中国国籍:
1 j7 M' L% @! o! p/ h8 L- ? C2 F" J 一、外国人的近亲属;
# U% X) u8 ?7 t 二、定居在外国的;
8 m3 [) F6 |2 J V* S3 ~, { 三、有其它正当理由。& t3 J( }4 d2 g' v0 v( y4 Q- t
第十一条 申请退出中国国籍获得批准的,即丧失中国国籍。9 l N v, Y% \- Z# p# h- |
第十二条 国家工作人员和现役军人,不得退出中国国籍。
; i" G7 B% w0 u2 P/ k: }6 n g 第十三条 曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。
t5 K: V7 e' K' p4 }+ o3 ~+ } 第十四条 中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。5 \; h, u( W4 O$ z* I
第十五条 受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。2 P. F( D1 h( a, L- v' @9 H7 [
第十六条 加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。1 C4 L B2 r/ M% J, J/ \# M) e
第十七条 本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。

Article 1

7 j" `! S+ x6 ebelonging to any of the nationalities in China shall have Chinese

" c% r4 e* J" ]% L8 A' l0 sAny person born abroad whose parents are both Chinese nationals or one of, q) d: A1 q9 n: V( p+ x* v8 [
whose parents is a Chinese national shall have Chinese nationality. But a- k+ ]6 Y; u! j' n
person whose parents are both Chinese nationals and have both settled
8 k' b2 {8 k# ~abroad, or one of whose parents is a Chinese national and has settled
1 ?0 _6 T9 P) [/ e5 i5 ^abroad, and who has acquired foreign nationality at birth shall not have

Article 6
+ [- d/ N; m# m6 ?# }5 jAny person born in China whose parents are stateless or of uncertain

Article 75 Y' K7 Y+ V/ L0 Y% H: r# x- c* T
Foreign nationals or stateless persons who are willing to abide by China''s0 A# S9 ^; _$ y$ K! O) W+ z
Constitution and laws and who meet one of the following conditions may be
" z+ K: ?& R J4 P6 ]2 w: Wnaturalized upon approval of their applications:* e2 C$ C4 d! b$ x+ ?! X
(1) they are near relatives of Chinese nationals;$ T( ?& @* C+ h7 u+ |; x- R2 _) T
(2) they have settled in China; or# |5 T# E( c* e# e+ l3 T8 i9 s% l
(3) they have other legitimate reasons.

Any person who applies for naturalization as a Chinese national shall
+ E1 N$ X Y1 m) v& cacquire Chinese nationality upon approval of his application; a person
|. ?( |" T' {; A0 m2 owhose application for naturalization as a Chinese national has been
- Y: {4 N) S5 ]( n3 n* Y/ Bapproved shall not retain foreign nationality.# `0 H* p* w$ G$ h! O& i3 L- t
Article 96 a) d. x2 X& v" L
Any Chinese national who has settled abroad and who has been naturalized
* [. R9 m6 U# K( G1 ?as a foreign national or has acquired foreign nationality of his own free
+ t& M9 M+ z; F4 u. \! x: o, rwill shall automatically lose Chinese nationality.
+ @, p3 ~1 Q$ V0 N eArticle 10: ?. U" Z4 y9 ~* W2 `6 O) a
Chinese nationals who meet one of the following conditions may renounce
( \1 F" A7 P5 o | d$ mChinese nationality upon approval of their applications:* X: ]3 _+ ?1 P$ B3 E$ e
(1) they are near relatives of foreign nationals;, i" U) ]4 v7 \0 j0 s) ^7 Z
(2) they have settled abroad; or
/ y9 [" J8 x$ u' e: ?3 v \(3) they have other legitimate reasons.

Any person who applies for renunciation of Chinese nationality shall lose1 V% \$ P" [" l% L
Chinese nationality upon approval of his application.2 s v/ z; D U3 [& Y
Article 12* C# }5 Q+ [8 O* Z% @. G
State functionaries and military personnel on active service shall not5 R: ^& j' u$ n& X% H' V0 _
renounce Chinese nationality.
) z- i1 h; u$ n3 U! G* f% }! t0 ?7 EArticle 137 b3 b; b; o% S( m0 [4 {
Foreign nationals who once held Chinese nationality may apply for
7 a' J& |4 F# j. d' K4 j. irestoration of Chinese nationality if they have legitimate reasons; those
" K6 e7 I8 k9 U& B$ _5 Lwhose applications for restoration of Chinese nationality have been6 A1 e2 N5 S! C
approved shall not retain foreign nationality.

( D, l4 ]4 C* X( tPersons who wish to acquire, renounce or restore Chinese nationality, with; B* |+ ~3 j$ n ~7 B/ Q
the exception of the cases provided for in Article 9, shall go through the
8 J5 I4 Z& A* w# f! hformalities of application. Applications of persons under the age of 18) B9 t- C* [1 L f
may be filed on their behalf by their parents or other legal

Article 15
5 z4 g' x2 G$ }7 |( x; U; v* UNationality applications at home shall be handled by the public security& o+ ^2 |5 ?# A ]6 x
bureaus of the municipalities or counties where the applicants reside;
6 z) S2 I1 `5 k6 qnationality applications abroad shall be handled by China''s diplomatic
( \# k$ h6 X4 Y$ B: ^- zrepresentative agencies and consular offices.1 ]; M+ E: j: l/ i' U. @
Article 16' S4 v9 @* \( I9 r5 M/ [% K4 O
Applications for naturalization as Chinese nationals and for renunciation! u( E. t) u( x# F3 \1 z, E- L
or restoration of Chinese nationality are subject to examination and
$ i# _) G D5 T/ aapproval by the Ministry of Public Security of the People''s Republic of0 q2 Y. v# J D. Q1 |" G
China. The Ministry of Public Security shall issue a certificate to any
) i% Y' a2 S3 N3 i& }1 mperson whose application has been approved.4 }, E0 j' y c/ i
Article 17: C" Z( ?, a4 N% P
The nationality status of persons who have acquired or lost Chinese4 @, O* r7 X. D2 M: l1 Y
nationality before the promulgation of this Law shall remain valid." ~0 R0 c5 u. C

This Law shall come into force on the day of its promulgation. |
