" w2 n1 H3 n# q7 F 第一条   中华人民共和国国籍的取得、丧失和恢复,都适用本法。1 ?8 t$ u: S, v- T( q# d
    第二条   中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。
1 \) h2 A+ E& u, F9 r    第三条    中华人民共和国不承认中国公民具有双重国籍。8 @* M6 H5 r6 Y; i1 m0 y
    第四条   父母双方或一方为中国公民,本人出生在中国,具有中国国籍。5 K+ p7 J8 {5 y3 M* f
    第五条   父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。. ?9 s) l+ C4 r; K( V
    第六条   父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。, k; n2 i2 p$ V: y9 z  D- C
    第七条   外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:
& W/ B2 O' R' V9 F. D1 j& n3 J    一、中国人的近亲属;
1 F1 |" ], X$ `% ?9 r1 s0 I" Y0 W( T    二、定居在中国的;
0 X$ N) p! ?# E( v( r+ c( N! ^    三、有其它正当理由。2 U( k+ ?) J4 Q+ l% Q
    第八条   申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。7 ]  Y& T$ b9 Y  O
    第九条    定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。; M$ r/ U: Q$ y
    第十条    中国公民具有下列条件之一的,可以经申请批准退出中国国籍:
% Z9 z% R3 N- G7 a  d* [) F    一、外国人的近亲属;. P" I6 \* U+ B' ~5 `$ P
    二、定居在外国的;7 X: ~8 y' `9 G6 G- x3 l+ J

    第十一条    申请退出中国国籍获得批准的,即丧失中国国籍。
- f7 O( s7 V- o    第十二条   国家工作人员和现役军人,不得退出中国国籍。
* A5 F0 W! x& H; \# D" Y    第十三条   曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。4 d/ H2 U' B% e
    第十四条   中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。
6 A4 V1 W, z6 z5 _    第十五条    受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。6 m0 m# v: g9 z9 W* Y
    第十六条   加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。
. k, L2 |5 ]4 ]# I) \2 b4 v    第十七条   本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。

% D8 b. x5 Z0 P% l& Y* SThis Law is  applicable  to  the  acquisition,  loss  and  restoration  of
1 p# O4 o7 V/ e- i' ^4 \6 b& a+ `nationality of the People''s Republic of China.
7 Z& k2 T  y+ V/ p; _) zArticle 2; w& S' w: t, N2 ^5 ?
The People''s Republic of China is a unitary multinational  state;  persons
/ i/ }+ V0 F0 q# X& k) \belonging to  any  of  the  nationalities  in  China  shall  have  Chinese: h4 a* s- T3 z/ w" g, B
nationality./ F8 m6 z* |5 ^6 O- b+ {
Article 3
7 y, A+ C9 L3 i6 M+ Y( {. WThe People''s Republic of China does not recognize dual nationality for any, d7 R" Z, `8 m7 \7 `; R
Chinese national.
- M" d' I4 u: C+ m  GArticle 4' O$ N+ x" n8 \1 x3 B, C
Any person born in China whose parents are both Chinese nationals  or  one! o# v: X4 B9 ~7 Q9 z
of whose parents is a Chinese national shall have Chinese nationality.
2 ?8 F  Y- o5 Q) g; DArticle 5/ h) T( v  h% q, @% G0 L9 L
Any person born abroad whose parents are both Chinese nationals or one  of6 D" i3 X- W, Z5 e, L! X, S
whose parents is a Chinese national shall have Chinese nationality. But  a
7 {4 d& ~7 W4 g% e+ X. Aperson whose parents are both Chinese  nationals  and  have  both  settled
) ^( L- f4 |. Q2 Labroad, or one of whose parents is a  Chinese  national  and  has  settled
1 ?# B2 _$ U$ K; q( W/ k) g4 qabroad, and who has acquired foreign nationality at birth shall  not  have
% Z. y* B: _+ M. G# n: lChinese nationality.
- R& @% Q& Z" e+ W& l6 H& |Article 65 m) k. I" A0 L
Any person born in China whose  parents  are  stateless  or  of  uncertain
" R" A1 V" t$ v) }: i7 znationality and have settled in China shall have Chinese nationality., q. B3 S% Q1 |% U( x4 f
Article 7( o1 I4 d( O$ P4 Z; M/ V5 b1 ~4 M: K
Foreign nationals or stateless persons who are willing to abide by China''s
6 p6 y/ ]' n9 ZConstitution and laws and who meet one of the following conditions may  be
5 T5 N, e6 d) v7 {naturalized upon approval of their applications:
, `3 q! S+ [& g(1) they are near relatives of Chinese nationals;
: z3 ]$ N" ]8 F' m* O(2) they have settled in China; or: H. Q! D" T4 [4 r0 ]( W* l
(3) they have other legitimate reasons.8 ?  U2 E3 b6 n4 y4 [
Article 8
, k& }5 a& X3 G  t: wAny person who applies for naturalization  as  a  Chinese  national  shall
& H% o' v# S& hacquire Chinese nationality upon approval of  his  application;  a  person/ h* Y* N: I4 h" `! n. E& F: C! X
whose application for  naturalization  as  a  Chinese  national  has  been5 u3 w' V* h! Q
approved shall not retain foreign nationality.2 `' w' q1 Z( Z) O" k8 t( y0 u: c
Article 9
+ ]6 }8 ~$ j# I8 N  NAny Chinese national who has settled abroad and who has  been  naturalized  z0 v7 S% W' F; s* B( G8 x& o
as a foreign national or has acquired foreign nationality of his own  free
, l" ~0 e9 J2 G0 r4 m1 e$ U3 _will shall automatically lose Chinese nationality.) n+ b2 N# L; Z( O: ]0 n+ Y7 k
Article 105 L) |% y8 u- N7 R
Chinese nationals who meet one of the following  conditions  may  renounce. G+ r4 w. R$ M6 N
Chinese nationality upon approval of their applications:# K' ]! a( j  R7 _
(1) they are near relatives of foreign nationals;
- B6 ?: {: a* S) x; Z3 [% D2 _6 T(2) they have settled abroad; or
9 ~9 _. A( [+ @(3) they have other legitimate reasons.* D( r' z0 Q1 K: o; p
Article 116 i2 ]5 X, N, z5 n; R+ Y
Any person who applies for renunciation of Chinese nationality shall  lose
" L. X6 e5 m/ i4 EChinese nationality upon approval of his application.6 o2 c8 ]1 V2 k  N' Y9 ~
Article 12' o2 G0 l1 h$ T$ ?
State functionaries and military personnel on  active  service  shall  not5 [2 |3 p$ O8 ~1 f/ |
renounce Chinese nationality.! m/ |2 X! A0 v
Article 13
$ o4 R6 r- y0 `Foreign  nationals  who  once  held  Chinese  nationality  may  apply  for
% N6 d2 U: d4 n6 zrestoration of Chinese nationality if they have legitimate reasons;  those
! L' Y; d7 Y, x4 owhose applications  for  restoration  of  Chinese  nationality  have  been
9 U* [  f9 ^4 R1 B' }approved shall not retain foreign nationality.* I; T# o; P& \8 ]( R$ T
Article 14
1 L" ]3 w2 L/ }* O( q5 K+ z" oPersons who wish to acquire, renounce or restore Chinese nationality, with* U  J  Z' w. n! p! G! ]
the exception of the cases provided for in Article 9, shall go through the6 k2 Y5 {& N5 Z( \8 u2 I6 y
formalities of application.  Applications of persons under the age  of  18# f9 A" J3 K' q4 O1 S1 n
may  be  filed  on  their  behalf  by  their  parents   or   other   legal
) r( Z- {9 R5 r* b1 Frepresentatives.4 Q1 U4 G7 P4 Z8 E9 {$ h7 S# R. Y
Article 15
5 q8 [  E3 n3 [4 h' |, b; S, vNationality applications at home shall be handled by the  public  security
& Q3 E8 W5 k9 m" k0 p5 P) xbureaus of the municipalities or counties where the applicants reside;$ y3 R/ ~, ?, t# P
nationality applications abroad shall be  handled  by  China''s  diplomatic; T0 y4 c( N1 b$ Z
representative agencies and consular offices.0 M% c  v7 ~; f, C% p5 V3 j( U# @
Article 16
$ R5 ]9 e3 U3 a9 xApplications for naturalization as Chinese nationals and for  renunciation
2 y7 O5 T+ Q' Y- {2 z& o$ Kor restoration of Chinese  nationality  are  subject  to  examination  and, B8 Z0 o& V( K& _4 y
approval by the Ministry of Public Security of the  People''s  Republic  of0 x1 w  M+ o  n% U( \5 _# \
China. The Ministry of Public Security shall issue a  certificate  to  any, M9 O# E# ^9 ~5 |8 j1 W( E
person whose application has been approved.
) A/ [; N6 K" r- n+ d- LArticle 176 T% z: Y: k- m% `) Q8 P
The nationality status of  persons  who  have  acquired  or  lost  Chinese# \. p) M0 C' L+ G5 Y
nationality before the promulgation of this Law shall remain valid.

& V$ G5 k" s3 L2 bThis Law shall come into force on the day of its promulgation.
