第一条 中华人民共和国国籍的取得、丧失和恢复,都适用本法。! F8 S5 p( c" H1 ~1 t
第二条 中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。
. Z! X' }+ D2 \* \/ u W 第三条 中华人民共和国不承认中国公民具有双重国籍。, b" h/ |! S+ w
第四条 父母双方或一方为中国公民,本人出生在中国,具有中国国籍。
2 s X" q" j- e+ m f. Y 第五条 父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。7 @* Y7 H {" m8 x) o4 D
第六条 父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。

二、定居在中国的;

第八条 申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。
9 q9 R$ F1 u* u& H. n 第九条 定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。
P4 p% \/ k9 V4 I# S7 r' I 第十条 中国公民具有下列条件之一的,可以经申请批准退出中国国籍:
; C9 @. a# @! x S 一、外国人的近亲属;
6 x6 U" o: P+ o9 n0 t; a& j* ?/ z* P 二、定居在外国的;

第十一条 申请退出中国国籍获得批准的,即丧失中国国籍。
# v/ D# n% y/ N7 y F 第十二条 国家工作人员和现役军人,不得退出中国国籍。
$ f& H3 x( D' t2 e$ y6 g 第十三条 曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。
# ]" a0 |$ [3 O# t u6 L 第十四条 中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。
5 d$ k) U0 p3 I# f& @6 ?6 ^' v 第十五条 受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。/ p8 r3 ^8 ?1 O: K
第十六条 加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。
( U* m" `( R- h3 i) i 第十七条 本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。

The People''s Republic of China is a unitary multinational state; persons

Any person born in China whose parents are both Chinese nationals or one

abroad, or one of whose parents is a Chinese national and has settled

Any person born in China whose parents are stateless or of uncertain

Foreign nationals or stateless persons who are willing to abide by China''s

0 J/ ~& \ c: N l(2) they have settled in China; or

Article 89 o1 F [5 P* z9 }' h" k: b& ^, J/ x
Any person who applies for naturalization as a Chinese national shall$ x7 h8 ~3 m3 y7 o7 w
acquire Chinese nationality upon approval of his application; a person* N. i8 e9 k# a
whose application for naturalization as a Chinese national has been
2 d/ w( R }& N4 s3 xapproved shall not retain foreign nationality.

. H% D/ E' [0 l" DAny Chinese national who has settled abroad and who has been naturalized, e j8 N- P8 S7 ]/ u# Y
as a foreign national or has acquired foreign nationality of his own free
9 x6 h/ s9 m2 U0 H mwill shall automatically lose Chinese nationality.2 C# P3 k' M3 ], ~* N+ ^
Article 10
- E* |% F. g9 S u% g2 |7 o2 T1 lChinese nationals who meet one of the following conditions may renounce/ A& N9 ]3 v" ]4 S
Chinese nationality upon approval of their applications:
7 H ~ g& Q/ S' V3 y(1) they are near relatives of foreign nationals;1 l$ c6 g$ b7 D1 O1 h, s7 _
(2) they have settled abroad; or9 V( K5 O3 [! I9 N' b9 |
(3) they have other legitimate reasons.

Any person who applies for renunciation of Chinese nationality shall lose
( `" U+ p! d7 n, uChinese nationality upon approval of his application.

% F, i/ k; K, Y, V3 {State functionaries and military personnel on active service shall not
( H. x7 n. `: p* c$ d' V$ R- D5 Vrenounce Chinese nationality.4 z7 m" I$ S) ^8 W5 p
Article 13
6 J1 P# Z; }, g$ AForeign nationals who once held Chinese nationality may apply for b+ P9 U( f! d% P2 p
restoration of Chinese nationality if they have legitimate reasons; those
/ ^. Y- f4 [1 e# pwhose applications for restoration of Chinese nationality have been
3 q8 q) q! ]0 F/ ^approved shall not retain foreign nationality.

Persons who wish to acquire, renounce or restore Chinese nationality, with/ }( W4 l$ T! a5 ]' [
the exception of the cases provided for in Article 9, shall go through the5 K0 E$ O4 z2 ^3 T1 l, {# T
formalities of application. Applications of persons under the age of 18
) l D! i* ~/ V( k% T7 rmay be filed on their behalf by their parents or other legal: A% {* e- |' @
representatives.$ T7 j8 Y. V: S2 v1 Y
Article 15
" I& ], B4 d; W) _7 HNationality applications at home shall be handled by the public security R8 B# C1 z6 {; G+ Q" q' T
bureaus of the municipalities or counties where the applicants reside;/ T- a5 L; ~; O3 z" |
nationality applications abroad shall be handled by China''s diplomatic( R9 j* R; _: z; a+ L+ u
representative agencies and consular offices.9 p2 F% [$ }# P5 L8 ~/ C
Article 16, S+ U }/ M# K& a) ?( g# k
Applications for naturalization as Chinese nationals and for renunciation
& K5 p g/ [) ?% Z' `) Ror restoration of Chinese nationality are subject to examination and* w3 q% y' Z/ V$ f. l% W
approval by the Ministry of Public Security of the People''s Republic of9 s6 y5 i$ {4 G P# E
China. The Ministry of Public Security shall issue a certificate to any% K5 J. X( A% ?- f5 R
person whose application has been approved.7 K: y2 t! b& Z/ r$ s
Article 17% F- R6 U6 ^6 P* R/ K
The nationality status of persons who have acquired or lost Chinese
3 O: |6 p8 u! K* I) H; }nationality before the promulgation of this Law shall remain valid.; B X3 p* F2 N. X: d

This Law shall come into force on the day of its promulgation. |
