& k- o; G' w) ~《中华人民共和国国籍法》
& W" g( z' r! ]9 G0 m  1 w; \& b8 s. p- N1 b5 D6 N1 f! Z
第一条   中华人民共和国国籍的取得、丧失和恢复,都适用本法。1 s' U8 C5 x0 W) \% v
    第二条   中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。/ O: E  ]& Y: h5 x/ k
    第三条    中华人民共和国不承认中国公民具有双重国籍。
! [7 S4 M& E0 n+ k7 b# E( `    第四条   父母双方或一方为中国公民,本人出生在中国,具有中国国籍。
% f  y5 a; F: O+ \" C; Q    第五条   父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。* L4 c, _8 M% U( d5 W! _* N: m7 a
    第六条   父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。+ L- m" ]+ s5 c2 D. h/ c
    第七条   外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:
( @$ g1 K1 @  {. u8 m    一、中国人的近亲属;: Q5 \( _5 i' Q6 s) C
    二、定居在中国的;4 a7 V& P6 ^% t7 R
    三、有其它正当理由。
* I( Z  K) X( k7 @  V( a    第八条   申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。3 R0 q) D. g, L8 L0 N/ h! J- a
    第九条    定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。
3 [9 ~) e2 J  b) V# z    第十条    中国公民具有下列条件之一的,可以经申请批准退出中国国籍:1 n/ i, e. M1 j
    一、外国人的近亲属;' k' z1 H+ Y# P8 v" q& j- c5 h
    二、定居在外国的;
2 Z% L$ W9 y* o: R, |, G    三、有其它正当理由。
1 x, R  u/ k! e) u) S    第十一条    申请退出中国国籍获得批准的,即丧失中国国籍。
6 S; j  y/ k7 t" n3 ]    第十二条   国家工作人员和现役军人,不得退出中国国籍。
1 f- I  R2 L; _7 m' v" _! Z+ G    第十三条   曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。
4 l( q9 D/ d" B: T; g    第十四条   中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。4 U( H) j: L  s
    第十五条    受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。4 W# J. g+ W8 s( n% u
    第十六条   加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。

    第十八条   本法自公布之日起施行。

9 I* I: |. Q3 E% uThis Law is  applicable  to  the  acquisition,  loss  and  restoration  of
* f! E$ b4 y7 L- y1 `. {# n4 Y3 Snationality of the People''s Republic of China.8 w+ _' o9 U$ O6 y
Article 2" C. d: L. w' o2 Q' T, K" K8 T
The People''s Republic of China is a unitary multinational  state;  persons" N) h9 S% K& K
belonging to  any  of  the  nationalities  in  China  shall  have  Chinese
/ r& e. S* `+ Y, Q2 Y  ~4 anationality.) i( @. r# ^! [, r* k5 j6 L! J5 U+ i& e
Article 3
3 [# C. K9 o' w8 M- Y3 bThe People''s Republic of China does not recognize dual nationality for any
1 t0 g3 D4 G* ~+ l  AChinese national.
8 a0 b7 J& ^9 Q, m& }/ j/ ]- NArticle 4; l5 Z, M2 i6 e
Any person born in China whose parents are both Chinese nationals  or  one
. [$ D; h# A" a/ V* ?of whose parents is a Chinese national shall have Chinese nationality.
9 N3 O+ E! b/ e7 xArticle 5; g9 `0 y0 o, p( H$ D/ A
Any person born abroad whose parents are both Chinese nationals or one  of: V) Z9 e4 [2 n) ^( {1 p
whose parents is a Chinese national shall have Chinese nationality. But  a+ M' `  y3 {5 r8 q
person whose parents are both Chinese  nationals  and  have  both  settled
0 W; U: q# i6 l  }abroad, or one of whose parents is a  Chinese  national  and  has  settled
" X; R3 {& s$ P+ Y) p0 L+ Yabroad, and who has acquired foreign nationality at birth shall  not  have: c" N) o  }; [
Chinese nationality.

8 L0 j+ _$ |: @; O0 `Any person born in China whose  parents  are  stateless  or  of  uncertain* i4 X$ J% P( C1 s
nationality and have settled in China shall have Chinese nationality.4 D4 X! F, H7 I
Article 7
; v% ?9 ^! q- p4 }) r- MForeign nationals or stateless persons who are willing to abide by China''s
  Y1 x$ q. ^" Q; O8 A1 m( ?# L* e4 ?Constitution and laws and who meet one of the following conditions may  be6 }' U+ Z, p( h2 @: x: z1 O
naturalized upon approval of their applications:5 G+ Z, p0 B! p; R9 i8 _# A
(1) they are near relatives of Chinese nationals;
$ v! e6 E5 `$ Q$ G(2) they have settled in China; or
. `" E; D  L$ ~6 b(3) they have other legitimate reasons.$ z' {2 S" R2 n5 f0 B0 R
Article 8
( c# C1 y( D  v. E! XAny person who applies for naturalization  as  a  Chinese  national  shall
  u3 G7 W0 N- D' Z; q2 A* p  W  Iacquire Chinese nationality upon approval of  his  application;  a  person
; I1 W0 s9 E/ Z# T( r5 e/ v* Swhose application for  naturalization  as  a  Chinese  national  has  been
% N/ Z) z( `5 w, vapproved shall not retain foreign nationality.' x4 H) `/ m6 t
Article 9
" V8 O1 F2 W" A- o- r1 YAny Chinese national who has settled abroad and who has  been  naturalized
$ k/ j% R3 q; J5 e6 J& V4 Bas a foreign national or has acquired foreign nationality of his own  free: c# `1 J2 ^1 f" v* C% v
will shall automatically lose Chinese nationality.
5 ?2 v0 _4 a7 uArticle 103 ~* `, w& E5 k- ]9 u" ~
Chinese nationals who meet one of the following  conditions  may  renounce' \4 x# G1 D! z* E7 v% ^. W: b
Chinese nationality upon approval of their applications:
' `6 t) P: w6 w- `$ M(1) they are near relatives of foreign nationals;
1 v1 m9 _, M* t, c(2) they have settled abroad; or4 ^  p! x4 R8 j! [0 V
(3) they have other legitimate reasons.
. e2 F' F* a4 H- G% S: W- gArticle 117 R3 p4 p& |0 K3 e6 p& T
Any person who applies for renunciation of Chinese nationality shall  lose# E4 t( e* j5 S/ r3 y8 y
Chinese nationality upon approval of his application.
6 e. Y+ U2 @/ `7 {6 uArticle 12. J- G. j; G8 {0 \  w+ e, |# d( z8 g
State functionaries and military personnel on  active  service  shall  not6 n& [9 `! N& S; z" u2 C
renounce Chinese nationality.
+ p0 M% g7 l! \Article 13
1 `* |5 x. A! [9 i# r) EForeign  nationals  who  once  held  Chinese  nationality  may  apply  for+ a# l! B( m) w' o) X: T6 T
restoration of Chinese nationality if they have legitimate reasons;  those6 b$ ^) a( R. n
whose applications  for  restoration  of  Chinese  nationality  have  been
0 z& x# G* H9 W6 J6 P  xapproved shall not retain foreign nationality., a5 I! @" p  O( ]1 f7 O, }0 _+ l! j
Article 14
& e7 u) O( S: U. sPersons who wish to acquire, renounce or restore Chinese nationality, with! v* a; ]- d3 @6 ?
the exception of the cases provided for in Article 9, shall go through the2 ^$ M& j# A- Y  M% i. v" H' H
formalities of application.  Applications of persons under the age  of  18- `( {6 {0 ?* \) m; Y, Z  E& {
may  be  filed  on  their  behalf  by  their  parents   or   other   legal
0 j* O/ R3 e: K# S7 _representatives.
/ q" m+ U2 G" I, V3 Q6 cArticle 15& M$ x  @  `# [7 s$ Y& W! z
Nationality applications at home shall be handled by the  public  security* |  t- A6 |% ?( ~, ]# k- ~
bureaus of the municipalities or counties where the applicants reside;* F/ @. ^, f) ^$ {
nationality applications abroad shall be  handled  by  China''s  diplomatic
- P2 o' w. p# i4 ~- Z- T$ `representative agencies and consular offices.
! ^5 o1 P* q2 x% z! b+ A9 KArticle 168 {4 @$ W" u6 K
Applications for naturalization as Chinese nationals and for  renunciation
. T2 G. G8 e- Ior restoration of Chinese  nationality  are  subject  to  examination  and
) g- g9 C- W/ d; Vapproval by the Ministry of Public Security of the  People''s  Republic  of0 @! [. q5 `& b  p6 N( d, d( t6 v6 s
China. The Ministry of Public Security shall issue a  certificate  to  any2 _( \& |: ?$ `* S' y  I& g% c
person whose application has been approved.5 z& s7 y* q7 A) |' Q) r
Article 174 @5 |0 \* `5 K8 q" R6 v
The nationality status of  persons  who  have  acquired  or  lost  Chinese
5 w0 w+ @" _6 U. l5 D* enationality before the promulgation of this Law shall remain valid.4 B# ~& @7 Y  D5 e/ ]; A: ]
Article 18
2 c( W7 a  ]+ I: O* XThis Law shall come into force on the day of its promulgation.
