《中华人民共和国国籍法》 ( w C. K6 T+ s. b. k' A
4 `/ t3 J2 \6 `" ^9 a: U+ B+ U 第一条 中华人民共和国国籍的取得、丧失和恢复,都适用本法。+ a. L" D7 t3 w3 E
第二条 中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。' y5 E: d! r) V2 q& ^7 Y2 e
第三条 中华人民共和国不承认中国公民具有双重国籍。
% j* ]4 _6 G6 D; H. @9 n; o 第四条 父母双方或一方为中国公民,本人出生在中国,具有中国国籍。
) @4 K0 I4 T! j0 @ 第五条 父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。
4 N+ [, U6 Z1 W) ^/ I: a/ U8 O 第六条 父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。
$ R" F, A6 L: j' a- H 第七条 外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:8 m7 F, H8 n( y% J
一、中国人的近亲属;

第八条 申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。
2 m% b* D. _" j$ z3 ]% y 第九条 定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。
! h$ x% n$ f% d5 j/ `4 j9 L 第十条 中国公民具有下列条件之一的,可以经申请批准退出中国国籍:
% k" X' ~# J& j& ~3 c8 v& i 一、外国人的近亲属;
) W: ?2 G2 k! W7 _ 二、定居在外国的;* A# k. r! J2 G2 [6 Q, \
三、有其它正当理由。

第十二条 国家工作人员和现役军人,不得退出中国国籍。! \( L6 ~ P7 z! s2 ]+ K
第十三条 曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。' g/ T+ V# V/ ]( w
第十四条 中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。
3 D* E# ?, v, \ 第十五条 受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。
) d$ H; {# _' J; ~ 第十六条 加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。

Any person born in China whose parents are stateless or of uncertain

Article 7
* H; ~/ l4 ^( Y9 [) dForeign nationals or stateless persons who are willing to abide by China''s: ^* U! W8 O! [; Q1 `4 `6 w4 _% Z
Constitution and laws and who meet one of the following conditions may be# n# R m( o( o5 ^
naturalized upon approval of their applications:" ^" t! Z3 z4 j* I: D( ?/ A
(1) they are near relatives of Chinese nationals;
- T' S" f& s; B: B- o(2) they have settled in China; or
. p# i6 [' y k" r b(3) they have other legitimate reasons.

Any person who applies for naturalization as a Chinese national shall! t2 z5 V* }( }3 i
acquire Chinese nationality upon approval of his application; a person$ z+ e- u- |" A) l+ t+ X, f
whose application for naturalization as a Chinese national has been; v0 J; y { Z* M0 d4 w* A0 W
approved shall not retain foreign nationality.

Any Chinese national who has settled abroad and who has been naturalized
X: I" p" i0 f4 Uas a foreign national or has acquired foreign nationality of his own free
1 K# t* ]& k9 ~/ V0 V. Mwill shall automatically lose Chinese nationality.9 ?) K* @9 ?) D- d
Article 10! ?5 Q* J/ N/ A8 @1 j* t( y
Chinese nationals who meet one of the following conditions may renounce
6 _& G& @- F/ x* [" y P# r$ g& YChinese nationality upon approval of their applications: d+ v* k* W: h \
(1) they are near relatives of foreign nationals;+ u" S. Z; W0 L+ `; @: e& d% L
(2) they have settled abroad; or
& F( V z+ l9 r: B5 R(3) they have other legitimate reasons.2 i0 ]4 B& n: b: `" V8 G
Article 11
( D: u/ C$ ]% N1 ~1 hAny person who applies for renunciation of Chinese nationality shall lose
' n2 ^, g3 ^3 X8 S. S* C6 x- XChinese nationality upon approval of his application.0 u. J, D9 y( h! r v1 q8 W
Article 12
7 A, p1 p7 J, y: ~State functionaries and military personnel on active service shall not
7 r3 H% h" d" Wrenounce Chinese nationality.
$ a4 v" ~ |$ V% c$ m$ fArticle 13
; I: s& A. P& I6 x; M" FForeign nationals who once held Chinese nationality may apply for: B$ Y' P$ W' i3 w
restoration of Chinese nationality if they have legitimate reasons; those- p0 Q k P2 Z0 g
whose applications for restoration of Chinese nationality have been
2 m7 O% t. ]6 Y$ S& ^3 Fapproved shall not retain foreign nationality.

0 X, ?% n# j1 e5 ]+ P' s- ~1 c1 L6 YPersons who wish to acquire, renounce or restore Chinese nationality, with/ e1 `% }1 ?9 `8 m6 O- @, K1 r
the exception of the cases provided for in Article 9, shall go through the* k! H8 d- G4 d5 b
formalities of application. Applications of persons under the age of 188 o K% n: j! n# F T
may be filed on their behalf by their parents or other legal3 W* C0 v% E7 ?8 X% u3 |( r
representatives.

+ F3 Y, Z# ]9 W0 u1 C' J8 w" \/ WNationality applications at home shall be handled by the public security- D$ S, e3 A* _! t
bureaus of the municipalities or counties where the applicants reside;3 n( K$ x9 `1 t4 F
nationality applications abroad shall be handled by China''s diplomatic
* A6 C+ C4 Q6 k# c4 mrepresentative agencies and consular offices.
- J+ n3 Q% a# L0 [' GArticle 16' n- [" G+ h2 X& v# |8 k
Applications for naturalization as Chinese nationals and for renunciation! f% G1 H% P. P- V7 o5 H
or restoration of Chinese nationality are subject to examination and
) s( c& k: V* z! r2 H9 G; t3 g* `approval by the Ministry of Public Security of the People''s Republic of/ f/ l6 o! p8 y6 T% _
China. The Ministry of Public Security shall issue a certificate to any
) |. c4 Q A. W& k. [, `, O+ Mperson whose application has been approved.
6 _- a* _$ z8 C% WArticle 17; R$ T6 x! V) {, v. L5 z9 s0 x
The nationality status of persons who have acquired or lost Chinese3 a. M" _2 E# x6 {+ }0 q
nationality before the promulgation of this Law shall remain valid.

5 @3 ?3 l9 r, {/ I$ \" u' C4 s; GThis Law shall come into force on the day of its promulgation. |
