中华人民共和国国籍法(附英文)

$ O+ K' L5 h5 J9 |0 x s 第一条 中华人民共和国国籍的取得、丧失和恢复,都适用本法。
! U3 {3 S4 X; r+ P% S4 _$ J 第二条 中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。
( z- L4 _# }0 N 第三条 中华人民共和国不承认中国公民具有双重国籍。
p6 Q4 n! U1 f& d" ^2 Q 第四条 父母双方或一方为中国公民,本人出生在中国,具有中国国籍。 Z2 U4 |( ?1 q2 ^" \: S/ w- g! h
第五条 父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。2 s& c9 \& R9 Z+ ]6 s
第六条 父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。
3 j" y" w( M: o* p 第七条 外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:/ o: V9 G" H2 v; b& x) O2 E% j
一、中国人的近亲属;
0 J) I8 E6 G' ^1 R$ \3 n 二、定居在中国的;, r9 b# a4 w& K
三、有其它正当理由。+ z/ p7 C3 o5 N9 }5 L( @ C, e
第八条 申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。, z% d6 [+ z" x1 U6 i8 {% h6 Q
第九条 定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。
0 \- H* g4 b% p5 y. w7 t 第十条 中国公民具有下列条件之一的,可以经申请批准退出中国国籍:
8 p; H. B2 j8 P9 @* C+ y7 x& u 一、外国人的近亲属;
7 j7 a+ _5 b0 e( l" i6 ~ 二、定居在外国的;5 k4 \7 E; i/ W$ _- w
三、有其它正当理由。
5 A+ ]3 j5 W y2 N; t 第十一条 申请退出中国国籍获得批准的,即丧失中国国籍。+ Y7 c3 M5 D6 N/ W5 I6 Z- D
第十二条 国家工作人员和现役军人,不得退出中国国籍。 q0 s; d$ b. ` l
第十三条 曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。
0 P6 O" _ ^3 @" }" ]: l 第十四条 中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。
4 R$ i+ c9 l: w' B$ o; \ 第十五条 受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。
- c: d* A7 @& S. m 第十六条 加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。
* `0 t, b/ r) A, l 第十七条 本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。

The People''s Republic of China does not recognize dual nationality for any

7 @) G% r2 A: a7 qAny person born in China whose parents are both Chinese nationals or one: Y. U% }9 H& t* `
of whose parents is a Chinese national shall have Chinese nationality.

whose parents is a Chinese national shall have Chinese nationality. But a

abroad, and who has acquired foreign nationality at birth shall not have

Article 6
) i0 R! X/ F3 v$ D8 J+ F) hAny person born in China whose parents are stateless or of uncertain5 R: s: }# m2 N# d( K( n) ^
nationality and have settled in China shall have Chinese nationality.

Foreign nationals or stateless persons who are willing to abide by China''s- {) P* J4 N: i+ }$ a O( z6 Z
Constitution and laws and who meet one of the following conditions may be K0 T! l5 F7 z% N0 ^) H# i
naturalized upon approval of their applications:: q% ^2 N, L4 J0 n) ^3 A
(1) they are near relatives of Chinese nationals;
5 P' L: j1 c. {' k" v" Y" E(2) they have settled in China; or/ Y* \# T3 n8 ]! F. {5 h$ Y0 u
(3) they have other legitimate reasons.

Any person who applies for naturalization as a Chinese national shall
! l' B5 ? ^% _+ q" Hacquire Chinese nationality upon approval of his application; a person% @3 N1 M* h2 F; `% r9 }
whose application for naturalization as a Chinese national has been
1 b$ x, ^( k5 E5 N% a" h0 l) sapproved shall not retain foreign nationality.9 [7 Y7 E h e( e3 k, e t
Article 9
7 _* l$ J5 D0 j2 b+ GAny Chinese national who has settled abroad and who has been naturalized
6 Z3 V' k" k. u6 O$ p8 xas a foreign national or has acquired foreign nationality of his own free
1 V2 G/ r( l% ~* f6 ewill shall automatically lose Chinese nationality.9 K8 O9 ]( D7 \7 }& b8 L
Article 10
U0 d) x3 z% x, V2 I) ]$ x' CChinese nationals who meet one of the following conditions may renounce, ~+ U7 S. y! n3 u( w, d, d' R. K* z
Chinese nationality upon approval of their applications:
% n$ n# a, p! [& a' L6 g8 c(1) they are near relatives of foreign nationals;
+ U& s2 A0 K$ \6 _(2) they have settled abroad; or" Q5 j+ s4 v. A, [- u5 ]
(3) they have other legitimate reasons.6 U6 F; b$ Y9 W
Article 11; k C/ @! A! Q
Any person who applies for renunciation of Chinese nationality shall lose+ U+ H1 t# i, T# v1 |7 ]8 x
Chinese nationality upon approval of his application.
) E' ^ C/ N& v5 ?& y9 }5 sArticle 12' X. v1 R3 X. A3 |
State functionaries and military personnel on active service shall not |' K! R8 T0 _" `: U( f
renounce Chinese nationality.
8 c$ N9 y1 _; TArticle 13- T: D8 ~9 K8 u P" E3 v8 s9 s) l
Foreign nationals who once held Chinese nationality may apply for
5 ~ b$ R9 s7 Lrestoration of Chinese nationality if they have legitimate reasons; those+ [. ]% t+ u0 w. @, E' ~
whose applications for restoration of Chinese nationality have been
3 U! H# d* @3 Eapproved shall not retain foreign nationality.

4 A; v: l( h: ^( ^. rPersons who wish to acquire, renounce or restore Chinese nationality, with; f* O$ o& f* K/ y) {- O5 P
the exception of the cases provided for in Article 9, shall go through the: R7 a$ i- i7 t- d. Q F% \
formalities of application. Applications of persons under the age of 18
6 k# u8 ^1 F4 r8 {4 D. [1 emay be filed on their behalf by their parents or other legal
/ n1 K8 H* |5 l) q4 G8 @5 ~# lrepresentatives.9 T% N$ A3 }/ V7 Y* Y% y+ z u' @ e
Article 15
; C5 _3 h$ B5 E: y" oNationality applications at home shall be handled by the public security! A& K; r' C9 }! ^6 S( a
bureaus of the municipalities or counties where the applicants reside;
2 n2 b7 Q* ^& v5 @4 `# g" hnationality applications abroad shall be handled by China''s diplomatic
/ F( ~) a3 ~: a$ c% u( D. [6 Wrepresentative agencies and consular offices.1 O$ }0 I5 o7 ?) b
Article 16! t1 D( N9 m& R
Applications for naturalization as Chinese nationals and for renunciation5 h+ f/ O5 b; v# Z$ C1 t
or restoration of Chinese nationality are subject to examination and5 U* M; S1 ~4 X% X
approval by the Ministry of Public Security of the People''s Republic of- \" R' K+ V8 L9 h8 t. U
China. The Ministry of Public Security shall issue a certificate to any. s, A; N2 x- N- A+ E/ F) A: p
person whose application has been approved.

1 Y6 A2 F! y qThe nationality status of persons who have acquired or lost Chinese
# v, p& @" O* n) I' Cnationality before the promulgation of this Law shall remain valid.

' C; g7 P; h. t" Z; iThis Law shall come into force on the day of its promulgation. |
