中华人民共和国国籍法(附英文)

  n! l/ F' p- Z6 ~+ [% P$ W; G  6 T/ S" R# w4 e" X
第一条   中华人民共和国国籍的取得、丧失和恢复,都适用本法。
" z$ U) S; }; ?: l    第二条   中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。! a& c+ v4 d3 Z
    第三条    中华人民共和国不承认中国公民具有双重国籍。
8 P9 F% _9 L; q    第四条   父母双方或一方为中国公民,本人出生在中国,具有中国国籍。
# Q. ?/ t# O# P% z& A) C# U( q    第五条   父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。
9 o: Q! W7 C' a: f( g& }    第六条   父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。$ s  v9 p' x) y3 Y  i7 O
    第七条   外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:! s, D* G' k5 `! e  c/ b
    一、中国人的近亲属;
* z8 [: \/ B% T9 V" u    二、定居在中国的;, D+ T" l$ g0 \% }. g  O* g- K& L
    三、有其它正当理由。
) i# E7 {, F9 H/ C$ \* p: m    第八条   申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。
2 ]# F& ?% l& X. j    第九条    定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。
1 _7 W2 N4 M5 B' ^4 d  J% S    第十条    中国公民具有下列条件之一的,可以经申请批准退出中国国籍:5 k* R+ d2 e: i
    一、外国人的近亲属;+ B$ Q1 Z8 k( e6 j4 `* J5 z
    二、定居在外国的;! ?6 K' h1 G4 b: Y$ z7 o
    三、有其它正当理由。
0 S- Z/ o( I/ e    第十一条    申请退出中国国籍获得批准的,即丧失中国国籍。
7 k, Z; J4 G( c' u$ w    第十二条   国家工作人员和现役军人,不得退出中国国籍。
5 i0 P4 [: c8 f+ |# h9 H    第十三条   曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。
/ b  v; B+ ~# a6 ^    第十四条   中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。$ O% M% {. \2 p4 y0 ]3 p
    第十五条    受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。- I: S2 N: H* A9 V3 b7 Z7 {0 F
    第十六条   加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。
1 Y% Z5 k* D3 n: _8 X    第十七条   本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。

. {. [7 I/ `$ N+ \% CThis Law is  applicable  to  the  acquisition,  loss  and  restoration  of
* K3 ~1 n. g, unationality of the People''s Republic of China.( [8 t/ w" t- R3 J+ @
Article 24 f) I+ `: G+ S& `% p1 I, e0 N" ~
The People''s Republic of China is a unitary multinational  state;  persons! b/ O8 @( |' h6 F: m
belonging to  any  of  the  nationalities  in  China  shall  have  Chinese- l, ?: T" I) g
nationality.
8 _0 p3 k4 n" A! L+ X# XArticle 3+ A) j: J- K% I2 V, r6 e
The People''s Republic of China does not recognize dual nationality for any: M9 k& y7 w5 {$ d1 V( F
Chinese national.
; Z+ b/ K/ U5 S. ]Article 4
; ?0 d1 t/ U1 _( s  W9 v, BAny person born in China whose parents are both Chinese nationals  or  one0 o" H4 M/ l  |- A+ x. K( }: L
of whose parents is a Chinese national shall have Chinese nationality.5 D2 {7 k; l5 _* j
Article 5
" k$ m6 a/ C2 y5 X9 p2 n# ?Any person born abroad whose parents are both Chinese nationals or one  of2 o- g! y2 i5 ~) ?) g# H2 @
whose parents is a Chinese national shall have Chinese nationality. But  a# I& H& Y$ E7 `- P9 [& {; O
person whose parents are both Chinese  nationals  and  have  both  settled
2 W$ Z( C/ F4 j0 yabroad, or one of whose parents is a  Chinese  national  and  has  settled1 p) g4 `4 Y% v) r5 X6 e9 S
abroad, and who has acquired foreign nationality at birth shall  not  have& ]# O- }. B4 A8 V$ n
Chinese nationality.9 D+ L, ~* f6 W4 E2 j, T! D8 `! P
Article 6
" y  ?4 @8 K0 p, Z0 tAny person born in China whose  parents  are  stateless  or  of  uncertain; P- v4 D) V( e8 T; @5 {- [
nationality and have settled in China shall have Chinese nationality.% E7 g; X0 }- r3 K, ^/ P
Article 7# ]5 f  x6 W2 B% S; V
Foreign nationals or stateless persons who are willing to abide by China''s9 J. r) a8 W2 T8 Z" q
Constitution and laws and who meet one of the following conditions may  be
) i+ F: R1 L6 Fnaturalized upon approval of their applications:0 u) Z0 _3 W- a3 a" C
(1) they are near relatives of Chinese nationals;' ]% s5 P! y4 Y  j' x* K$ q
(2) they have settled in China; or
0 s! g4 u6 A  C: g(3) they have other legitimate reasons.3 o/ F+ ]( D: p
Article 8
8 `4 }8 j9 G3 E1 `Any person who applies for naturalization  as  a  Chinese  national  shall
& _& P& Z$ Q8 z: ^) i9 E: Nacquire Chinese nationality upon approval of  his  application;  a  person
! v" [( |+ e! E7 k/ Fwhose application for  naturalization  as  a  Chinese  national  has  been( d, G9 J- q, d% @
approved shall not retain foreign nationality.
9 F5 M  u: r: g5 SArticle 9
9 G. p' @1 t# l! w& hAny Chinese national who has settled abroad and who has  been  naturalized
( i; Z$ }" S7 ]6 m& X& u3 Was a foreign national or has acquired foreign nationality of his own  free3 i8 \, o4 A* `4 t: ]4 R
will shall automatically lose Chinese nationality.
( ]# @' u4 X2 `8 JArticle 10( y8 X$ T( Q& N7 z% g9 o: d
Chinese nationals who meet one of the following  conditions  may  renounce7 ?6 G# B/ I$ b! G
Chinese nationality upon approval of their applications:* [% E# i: S9 i
(1) they are near relatives of foreign nationals;
& Y7 G/ J7 C& y2 w# U7 `(2) they have settled abroad; or
5 p. M' P7 u. g0 ^9 Z(3) they have other legitimate reasons.  Y; O( X1 D7 r& `$ I0 H1 w& H0 Q
Article 11
; i- R/ A" A& ?5 tAny person who applies for renunciation of Chinese nationality shall  lose
. m8 }( x7 J) J" wChinese nationality upon approval of his application.! c6 E) g; j5 R+ c, ~
Article 121 d0 ]! q1 G4 J/ _& v( T) y- N' Z
State functionaries and military personnel on  active  service  shall  not' {5 u: w* {% P
renounce Chinese nationality.3 e1 S& H5 E' K8 R
Article 13
) H6 d1 a0 l! _Foreign  nationals  who  once  held  Chinese  nationality  may  apply  for
6 i) _0 M  d2 ?5 hrestoration of Chinese nationality if they have legitimate reasons;  those
& m# i9 _7 _/ ^$ \  Hwhose applications  for  restoration  of  Chinese  nationality  have  been) ?2 v1 I0 _# c  L
approved shall not retain foreign nationality.
& p, ^1 C. j/ C6 k, U/ TArticle 14
$ w, q% J9 l8 W2 n4 Y1 e4 NPersons who wish to acquire, renounce or restore Chinese nationality, with
8 |9 i7 `% C& w6 A! r' J: jthe exception of the cases provided for in Article 9, shall go through the: U$ a# J6 U. ?2 o- T* M* Z
formalities of application.  Applications of persons under the age  of  18
+ J& T6 [2 \  I' R, N# h" Amay  be  filed  on  their  behalf  by  their  parents   or   other   legal9 k' C2 a/ S4 p2 B4 W
representatives.: R2 Z' A  ^" L' v
Article 15; i+ A+ ?) H+ r5 o2 B5 C: C" D
Nationality applications at home shall be handled by the  public  security
1 i+ I; H, a' g( C: u! xbureaus of the municipalities or counties where the applicants reside;
: `$ L! D4 B, Qnationality applications abroad shall be  handled  by  China''s  diplomatic! `& K( B1 v6 g# ]0 @# l. h, `
representative agencies and consular offices.
! w! P. x+ x+ S! SArticle 169 B( h! k. Q1 g/ I0 g
Applications for naturalization as Chinese nationals and for  renunciation
" j5 ?4 q0 ?* h6 y9 Dor restoration of Chinese  nationality  are  subject  to  examination  and
6 n! R- l' q% V4 @, Iapproval by the Ministry of Public Security of the  People''s  Republic  of1 U# H& C2 I3 ^" ?) t; {
China. The Ministry of Public Security shall issue a  certificate  to  any
0 m: N  m, ~9 a1 Y. fperson whose application has been approved.
& K) n$ `) s* b1 _# lArticle 17
# e( n, W% E. S$ T2 F3 ]3 O# w4 MThe nationality status of  persons  who  have  acquired  or  lost  Chinese
. f  k9 Y% |- c+ ?( B$ Z. Jnationality before the promulgation of this Law shall remain valid.0 c6 f5 v( q9 u  z# A" D+ |. l
Article 18
0 F, M* b; A# m- F0 oThis Law shall come into force on the day of its promulgation.
