第一条   中华人民共和国国籍的取得、丧失和恢复,都适用本法。- T  i$ n' K+ b9 N7 {( ?. n
    第二条   中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。
* k/ S. X, d" A7 ?) \6 F    第三条    中华人民共和国不承认中国公民具有双重国籍。
0 b6 ?8 H1 h% v+ l& p, G; ?" C    第四条   父母双方或一方为中国公民,本人出生在中国,具有中国国籍。
8 w, I1 g0 \" J: V7 Z    第五条   父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。/ S5 \) v+ h5 @. h# a& ]
    第六条   父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。
- |5 x, C" V4 E- s    第七条   外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:0 _6 c6 A/ v5 |
    一、中国人的近亲属;: d8 `0 ^' n) u: h# \2 l" b1 a* D0 Q
    二、定居在中国的;
" p! f( ^2 {' X9 U/ e    三、有其它正当理由。
0 Z- Q9 r1 q4 _' D* A2 I0 F    第八条   申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。
( i# F( j% b( ?9 d- p" G    第九条    定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。/ W' c- ?- Z+ h2 U; j) X) {
    第十条    中国公民具有下列条件之一的,可以经申请批准退出中国国籍:
! L( i. c" X4 \: P- i    一、外国人的近亲属;2 ?$ ?3 @5 v/ R8 P; g0 o
    二、定居在外国的;
) F+ @8 U, }- Q    三、有其它正当理由。3 i  D6 [0 l) ~1 a9 z% H: ?
    第十一条    申请退出中国国籍获得批准的,即丧失中国国籍。
( U% t3 T4 e9 `$ f& M' |    第十二条   国家工作人员和现役军人,不得退出中国国籍。
4 e: K( L' t) J3 w5 ]$ b8 H    第十三条   曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。' \9 C& \' _7 s1 d0 D9 ^* k8 @
    第十四条   中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。7 M8 L# B, ]- _' a0 y/ Z
    第十五条    受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。
+ e% Q0 S% }, B3 r    第十六条   加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。9 M/ G4 U# A" [2 L& k- z2 z' h
    第十七条   本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。

Article 1
0 d6 d) M! E, ~3 K! w' Z1 Z# h6 {: AThis Law is  applicable  to  the  acquisition,  loss  and  restoration  of4 t0 E! q5 W. I3 e
nationality of the People''s Republic of China.
2 ]: e; s9 N2 L* r, D+ ^8 y" B$ yArticle 26 M# Y: r2 k6 S, ^% d" c
The People''s Republic of China is a unitary multinational  state;  persons
* J# m( C% l, }: L" i( Hbelonging to  any  of  the  nationalities  in  China  shall  have  Chinese, j- @3 k! j5 V8 C& M
nationality.
3 D( t8 M! k- ?. F; ]" rArticle 30 P) R) \2 U: n) n
The People''s Republic of China does not recognize dual nationality for any8 |6 @: V) E( K. b% ~" V
Chinese national.# @4 g) c: |6 y) C
Article 4
, N+ R4 D* `: n: MAny person born in China whose parents are both Chinese nationals  or  one9 z. y0 [; w8 B
of whose parents is a Chinese national shall have Chinese nationality.0 l3 ~+ {( h1 z  M& `
Article 5
6 b+ B$ ^8 v$ NAny person born abroad whose parents are both Chinese nationals or one  of
, \( r8 R- r: ?whose parents is a Chinese national shall have Chinese nationality. But  a  O# [, X4 ^# e0 \4 o; i
person whose parents are both Chinese  nationals  and  have  both  settled, o" p0 k  W: m
abroad, or one of whose parents is a  Chinese  national  and  has  settled
0 e6 N7 f8 `$ h& g8 ?abroad, and who has acquired foreign nationality at birth shall  not  have, h* ~9 m: M  Y" {* Z4 v
Chinese nationality.0 |3 f( y) c4 x; D- |# e  ^
Article 61 y% ]1 t" V3 H
Any person born in China whose  parents  are  stateless  or  of  uncertain2 n$ d; E% J$ d0 c- _- I
nationality and have settled in China shall have Chinese nationality." D! f+ P' ]1 Z
Article 7- i+ D: L: h. M5 a5 v* B2 g
Foreign nationals or stateless persons who are willing to abide by China''s
8 c& J( d3 O7 ~2 uConstitution and laws and who meet one of the following conditions may  be
0 u: ?; Z' l1 r( nnaturalized upon approval of their applications:: X% j3 M3 {/ ?: K
(1) they are near relatives of Chinese nationals;
9 u( T- O) L* ?  [6 g* T(2) they have settled in China; or1 ?5 u/ ^! N4 N
(3) they have other legitimate reasons.) z) y  X- g8 F
Article 8! c, Z0 O6 r, h& _3 }6 K) e: Z
Any person who applies for naturalization  as  a  Chinese  national  shall
  i) n( o: Z; }acquire Chinese nationality upon approval of  his  application;  a  person0 U( B; _7 }/ _6 B4 v5 |  U, b
whose application for  naturalization  as  a  Chinese  national  has  been
" i" M- m# b( b3 w  r, Uapproved shall not retain foreign nationality.
7 |) C# F8 B2 R8 K# wArticle 9# L4 U( v' G  g/ X0 X$ }
Any Chinese national who has settled abroad and who has  been  naturalized! L8 p+ A8 X! d2 @7 p* {8 K
as a foreign national or has acquired foreign nationality of his own  free% S% |$ F1 W1 f+ r1 T) p# s  [
will shall automatically lose Chinese nationality.
* @3 V( N" L- N: J( t( h$ I- w, [Article 10
& ?5 c7 m4 ]' p7 Q2 LChinese nationals who meet one of the following  conditions  may  renounce
5 p$ @+ g3 W3 f* E: G' xChinese nationality upon approval of their applications:3 M. L* k6 }: M* }3 k; Z* i
(1) they are near relatives of foreign nationals;  g1 v$ B5 V7 @: u: J
(2) they have settled abroad; or4 Z* F/ P' |" S5 W, W; E" P
(3) they have other legitimate reasons.0 Y$ }0 V0 R9 D6 t6 ~- \/ y
Article 11
3 o: x1 m+ o" t- Y& A* h: cAny person who applies for renunciation of Chinese nationality shall  lose" ?0 Y/ h7 G8 K3 F0 u/ i
Chinese nationality upon approval of his application.
  C+ K& [. b: j0 z) B& ~. }+ Y) ^7 qArticle 12( K6 F5 O# Z4 u9 n# E; J  {
State functionaries and military personnel on  active  service  shall  not7 c. d4 ^9 _$ y: z6 [7 P6 o3 o7 A
renounce Chinese nationality.) L9 W4 \6 D1 U1 p  f9 m
Article 13/ @" U% \( e+ N; t+ p+ W% k
Foreign  nationals  who  once  held  Chinese  nationality  may  apply  for
* w8 `+ q' d) U: M/ H- }7 ?5 hrestoration of Chinese nationality if they have legitimate reasons;  those' O) ^, C; B* q: ]7 a: ]
whose applications  for  restoration  of  Chinese  nationality  have  been
+ e4 O- e7 |, R1 R0 L# U' qapproved shall not retain foreign nationality.2 z" p3 a! M- `; E- p1 ?
Article 14
# g8 T; w! `4 W. {3 M1 A' SPersons who wish to acquire, renounce or restore Chinese nationality, with
2 J, K4 [: I0 R3 Z0 K- A& Vthe exception of the cases provided for in Article 9, shall go through the
8 q9 V  F0 I1 O! ?$ yformalities of application.  Applications of persons under the age  of  18
5 i6 d- r1 t' ~1 umay  be  filed  on  their  behalf  by  their  parents   or   other   legal4 I, V$ b9 X. B" a" G3 w
representatives.# l) [0 s# _: _9 `: O
Article 15
  A# ]; l, o8 U- _3 l" \Nationality applications at home shall be handled by the  public  security4 l5 Q. D* z& y1 W4 R0 `/ m
bureaus of the municipalities or counties where the applicants reside;
" x; K9 ~/ w% u" A+ B, i6 v9 I! H/ N, _nationality applications abroad shall be  handled  by  China''s  diplomatic
$ \1 \+ B3 ^$ X" E* g( |, G( \representative agencies and consular offices.
0 K3 I' |: b) L2 HArticle 16
6 e# L$ s8 W& T) ]- G1 _5 v4 X0 Z8 LApplications for naturalization as Chinese nationals and for  renunciation3 c$ Q! M. \( r9 g
or restoration of Chinese  nationality  are  subject  to  examination  and
" o$ ]1 Z( p/ _. G, Kapproval by the Ministry of Public Security of the  People''s  Republic  of1 z4 P& ^( s, N4 a$ P
China. The Ministry of Public Security shall issue a  certificate  to  any" S. `) q! h& ]% e/ i, ], {
person whose application has been approved.5 F9 W, S/ d% N6 F
Article 17
. I3 m3 R2 Q: N/ M# |6 jThe nationality status of  persons  who  have  acquired  or  lost  Chinese
* M- E; J. V& B0 t, h2 Znationality before the promulgation of this Law shall remain valid.* E- a) r; @. r/ k7 ~# w
Article 18
" p. m7 F% x1 yThis Law shall come into force on the day of its promulgation.
