( |9 t8 K9 ?" v《中华人民共和国国籍法》 ! u- g4 u. E/ {3 k2 u
 
4 \# b5 h0 E* M% b 第一条   中华人民共和国国籍的取得、丧失和恢复,都适用本法。1 S* m6 @3 c  z, t' q7 W; I& O
    第二条   中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。
' z4 f9 Q9 `# d1 J    第三条    中华人民共和国不承认中国公民具有双重国籍。
  a) B  j; U& W! k0 @    第四条   父母双方或一方为中国公民,本人出生在中国,具有中国国籍。
6 i) p6 {' c% d5 r* n. o    第五条   父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。
' Z; Q* E5 Q  l% l    第六条   父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。
2 z4 F/ D8 E+ s    第七条   外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:
$ w& d3 s+ N8 N/ _3 w    一、中国人的近亲属;/ J6 A8 _0 A# N4 R
    二、定居在中国的;+ W( m7 m2 _. u3 J
    三、有其它正当理由。
- g5 l2 x. ?7 u$ g    第八条   申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。' i$ L( l/ [: t/ b- n' z6 ~# N
    第九条    定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。
2 D6 J, d( ^0 c# m# k: \. Y    第十条    中国公民具有下列条件之一的,可以经申请批准退出中国国籍:
. [9 m( Q5 p# b) @4 D    一、外国人的近亲属;% Z- ]3 B* ?+ w6 V8 O8 r6 R
    二、定居在外国的;
# q1 H% r8 r$ A- Y/ z, w% Z+ O    三、有其它正当理由。
& C. }( @" U' S    第十一条    申请退出中国国籍获得批准的,即丧失中国国籍。& m% G( e: k* K8 b
    第十二条   国家工作人员和现役军人,不得退出中国国籍。
- G$ U1 M+ o3 o, ^    第十三条   曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。
2 q9 D  p7 ^& L; O0 ^8 S    第十四条   中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。! {0 I% `  ?2 q! h' `
    第十五条    受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。+ B4 e: s* \7 w( J. L0 [) k
    第十六条   加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。

# ?2 r% M8 i0 d* cCommittee of the  National  People''s  Congress  on  and  effective  as  of

Article 10 g" I* z' i+ u
This Law is  applicable  to  the  acquisition,  loss  and  restoration  of* R3 M; R% @) X: y
nationality of the People''s Republic of China.
. C% m: e7 q. R( f+ g9 uArticle 29 w) u6 J, [# J& V9 D$ h
The People''s Republic of China is a unitary multinational  state;  persons; _; X2 e5 J) N
belonging to  any  of  the  nationalities  in  China  shall  have  Chinese/ e8 m# r0 B, C- i* ~' O" [7 |
nationality.
7 a& n1 G0 X! w; j$ [Article 3
1 y' t8 u# J0 C, ~3 ?; j4 j/ XThe People''s Republic of China does not recognize dual nationality for any/ b; X! `. z$ ]* ~
Chinese national.' d; Q4 ?/ }3 U) F1 T# ?2 C
Article 4
1 u% j8 P* n8 t/ s! p; F/ `Any person born in China whose parents are both Chinese nationals  or  one! d$ b) G' [/ A, m2 C
of whose parents is a Chinese national shall have Chinese nationality.
( w9 ?. S; v1 F$ YArticle 5% s, U$ s# a* D
Any person born abroad whose parents are both Chinese nationals or one  of
% Z, \; u) B' O( b6 L+ u/ `0 ]9 k  M, G# uwhose parents is a Chinese national shall have Chinese nationality. But  a
8 a( K: M( c2 o* y  gperson whose parents are both Chinese  nationals  and  have  both  settled$ w! @4 I2 a+ n0 t$ Y
abroad, or one of whose parents is a  Chinese  national  and  has  settled" u; N/ [7 u3 f- l$ W5 k
abroad, and who has acquired foreign nationality at birth shall  not  have
2 k) l6 F. @. j3 vChinese nationality.
% F* i2 X; i5 a; Y4 |& rArticle 6( D/ P& O. ?0 w6 ], q
Any person born in China whose  parents  are  stateless  or  of  uncertain( ^8 t* ^+ M/ Y
nationality and have settled in China shall have Chinese nationality.
. A/ S; z8 o7 ~* E! V0 ~8 WArticle 7( Q$ @) e1 T# m5 `( z6 p
Foreign nationals or stateless persons who are willing to abide by China''s! X. V$ n- C0 K+ i" d7 M0 z& P) [, _9 Q6 j
Constitution and laws and who meet one of the following conditions may  be8 W9 c, D: `  \1 u
naturalized upon approval of their applications:- |, i: ?* Z, ^4 c7 k
(1) they are near relatives of Chinese nationals;
" d& `5 F/ ~5 U; B8 g! E2 C(2) they have settled in China; or6 d, q1 c! U1 Z& a
(3) they have other legitimate reasons.
! |6 H, s8 B- W$ t3 bArticle 8
3 j" Z; ^- E9 o1 n9 V! tAny person who applies for naturalization  as  a  Chinese  national  shall
6 W: w2 l' ^& F3 y0 racquire Chinese nationality upon approval of  his  application;  a  person
/ i9 F( H* W  S7 m0 C3 A, Gwhose application for  naturalization  as  a  Chinese  national  has  been5 J' u! O- V- `. p/ \, ?- S  d
approved shall not retain foreign nationality.7 r% }- k9 ]4 c# E1 S( q- Z
Article 9
& `! O" z0 P5 @, y( g/ c- u' N' rAny Chinese national who has settled abroad and who has  been  naturalized
# _$ a: o" T% `( |% W/ |8 nas a foreign national or has acquired foreign nationality of his own  free) o1 d1 h  L# q+ _: D* ]1 j
will shall automatically lose Chinese nationality.0 N6 F, Y7 I& C8 U' s: t9 `
Article 10
; K! X; w9 c# X. d, GChinese nationals who meet one of the following  conditions  may  renounce
; Y$ r+ V2 {4 t9 b4 B4 cChinese nationality upon approval of their applications:5 \0 B$ K9 z5 h8 r. M5 h8 j- R
(1) they are near relatives of foreign nationals;
( J, p0 U* t! G2 C(2) they have settled abroad; or7 [% G6 i) n2 {1 @. v0 u. b" [
(3) they have other legitimate reasons.7 {% k; ?& C5 W- H2 Z
Article 11  Y+ O6 Y/ r& r' \+ f$ R8 V3 y
Any person who applies for renunciation of Chinese nationality shall  lose% l+ C& k; k" B& U) Y! j
Chinese nationality upon approval of his application.. W% [- ]% z" k, p/ [
Article 12
6 B' s3 R% T! w& m/ EState functionaries and military personnel on  active  service  shall  not8 b+ Q! o9 ?. a' q$ u- x) c  u' U
renounce Chinese nationality.
/ m3 w; C1 X% q( ^7 w. `. \Article 13
, q2 Z+ ^, u0 L4 v" V2 U6 PForeign  nationals  who  once  held  Chinese  nationality  may  apply  for
# T' T2 P/ |8 }$ ]" E. F! b. jrestoration of Chinese nationality if they have legitimate reasons;  those
8 H: ?2 F+ `; c/ m+ ]9 \. g& Owhose applications  for  restoration  of  Chinese  nationality  have  been6 }8 b, F: E8 X+ U
approved shall not retain foreign nationality.: s0 R3 J( i1 e
Article 14& Y; z( W( G# _7 U3 W1 B9 |
Persons who wish to acquire, renounce or restore Chinese nationality, with
0 v4 `& Z/ A, m' w2 |the exception of the cases provided for in Article 9, shall go through the
4 ?  w* I" e6 [0 Lformalities of application.  Applications of persons under the age  of  18, x( R+ u. }2 e& o: l  U" N' S
may  be  filed  on  their  behalf  by  their  parents   or   other   legal
9 p" V  _" d7 u3 m. _representatives.  F: A$ c; }, C+ K8 T
Article 15
, }& w8 }8 @0 ?4 ]" Q8 d2 E8 l, i% xNationality applications at home shall be handled by the  public  security! O% P) v5 y( |5 C
bureaus of the municipalities or counties where the applicants reside;/ X) f4 I( x3 R) G, _/ R8 e
nationality applications abroad shall be  handled  by  China''s  diplomatic
) i( T+ [5 f. R# R, s6 prepresentative agencies and consular offices.0 {& \* ?: e% {) b! x
Article 162 r/ U* g; J% @6 j$ B5 u# ?, M# {) e6 B
Applications for naturalization as Chinese nationals and for  renunciation+ o* J. {) W: `- B2 R8 M. Q
or restoration of Chinese  nationality  are  subject  to  examination  and
( R" r8 k+ \8 v3 p/ oapproval by the Ministry of Public Security of the  People''s  Republic  of! ?4 T8 I" O3 [) Z6 {8 q: P
China. The Ministry of Public Security shall issue a  certificate  to  any
1 ~/ c$ i' k' e/ q' @! _person whose application has been approved.
8 ?+ m& U. ]3 zArticle 17
4 X9 J, v. i  s# w; @$ hThe nationality status of  persons  who  have  acquired  or  lost  Chinese
* L" t2 K( C/ T2 rnationality before the promulgation of this Law shall remain valid.8 s$ d$ j$ u% P. `+ H  z6 X! I
Article 18
6 R* ]" U* u' VThis Law shall come into force on the day of its promulgation.
