/ S+ k1 V1 Q) Q: L8 i/ _5 W 第一条   中华人民共和国国籍的取得、丧失和恢复,都适用本法。% o! t/ o) b: \# _8 }
    第二条   中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。0 g, o* O6 F1 E* ?( s8 ^3 h! E" O7 X/ b6 k
    第三条    中华人民共和国不承认中国公民具有双重国籍。& ^) ?5 E) K. ]( W' L4 k
    第四条   父母双方或一方为中国公民,本人出生在中国,具有中国国籍。
! N- w6 s: v. c5 ~$ A' Y    第五条   父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。
! b& V5 L1 g) w9 e1 |* G' x8 N$ O    第六条   父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。$ `7 x" m% g* A) x) W' H" M, I1 _; R
    第七条   外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:- a$ ]2 I4 h" N0 j- G
    一、中国人的近亲属;
( E  v- C" z( l    二、定居在中国的;2 t+ F  c9 @5 V9 d2 Z
    三、有其它正当理由。  E: l, g+ n3 ?0 A4 e
    第八条   申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。
/ [/ ?% Y- n2 `. g2 Z# [    第九条    定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。
+ ^$ E, M' {# _5 U2 I    第十条    中国公民具有下列条件之一的,可以经申请批准退出中国国籍:
5 r2 P* D! ]& o. z% j- U    一、外国人的近亲属;
: G/ P/ D, U) D% n1 j    二、定居在外国的;3 L8 m7 O4 f  g) z  ?
    三、有其它正当理由。% V1 Y# C. C+ R- |9 N
    第十一条    申请退出中国国籍获得批准的,即丧失中国国籍。: c% t$ p3 T( P/ r
    第十二条   国家工作人员和现役军人,不得退出中国国籍。
& s9 U" K7 o: t* o    第十三条   曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。
2 @3 H0 W$ f0 k. g    第十四条   中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。# l3 t& I- e) A7 B. R
    第十五条    受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。4 N: W( M0 h6 H0 T9 }- E
    第十六条   加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。
- h- V% h: D1 q  M9 n& g    第十七条   本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。

/ A7 I$ M# u5 U2 [1 d/ d: xThis Law is  applicable  to  the  acquisition,  loss  and  restoration  of
1 W3 ~9 J6 N) N" o% J3 Q. o, z* ynationality of the People''s Republic of China.+ L- r1 [+ g7 a9 `3 x
Article 2
! `" U" _* {6 W% v% }  OThe People''s Republic of China is a unitary multinational  state;  persons7 k# m4 F, V* N4 a0 p5 }( q
belonging to  any  of  the  nationalities  in  China  shall  have  Chinese! n) X6 P% n; \. ?  Q- b
nationality.) i1 j$ I' B- o
Article 3
/ [( b- a7 ~, w3 V  ?: f: `The People''s Republic of China does not recognize dual nationality for any
1 Z6 a7 A3 U' I7 ^Chinese national.8 Q" E: U0 r; m/ q# ~
Article 4
* o( `. ~1 g& s6 }% B* eAny person born in China whose parents are both Chinese nationals  or  one* B6 s6 b' [" }( B* O9 B2 h
of whose parents is a Chinese national shall have Chinese nationality.! f' ?6 H+ D1 S: l6 m. u5 j
Article 52 S3 N8 w3 t8 n6 |6 T
Any person born abroad whose parents are both Chinese nationals or one  of
( o) u3 M' K+ qwhose parents is a Chinese national shall have Chinese nationality. But  a
) b  r3 e# M0 a# A! \person whose parents are both Chinese  nationals  and  have  both  settled2 o) {$ `1 A" X& u6 o4 D
abroad, or one of whose parents is a  Chinese  national  and  has  settled2 Z* A1 q) Y* K: y* o, G
abroad, and who has acquired foreign nationality at birth shall  not  have+ a0 `* M5 |6 {( _
Chinese nationality.
9 G8 W/ ^# m# VArticle 69 H5 x" M& U4 G  Z2 O
Any person born in China whose  parents  are  stateless  or  of  uncertain6 L$ W! R2 Q! h# n$ w
nationality and have settled in China shall have Chinese nationality.; n8 \( T  o+ i
Article 7" i7 u( z+ _3 l7 R* i
Foreign nationals or stateless persons who are willing to abide by China''s
3 }- q, H& d; a1 H1 HConstitution and laws and who meet one of the following conditions may  be
  y! e4 d7 x" {2 M6 Dnaturalized upon approval of their applications:
8 J, Q; v9 T4 ~' d  v(1) they are near relatives of Chinese nationals;
8 }! l! s+ }8 r# U# U8 \6 i(2) they have settled in China; or6 a9 h$ u1 D) T" P* P# j& i: e
(3) they have other legitimate reasons.* N7 _$ `% w: @4 }- t' `! Z' ]
Article 8( g4 q* }" j  n; T6 p, t9 K
Any person who applies for naturalization  as  a  Chinese  national  shall# ~7 u8 ^) C* ?- @: a1 Y
acquire Chinese nationality upon approval of  his  application;  a  person4 o2 T5 s( x, z0 W% I* o! f' w5 [2 O
whose application for  naturalization  as  a  Chinese  national  has  been
2 {/ r0 |% Y9 \7 |8 }approved shall not retain foreign nationality.
9 m0 M8 ~9 T  ?2 I* \Article 9
# {* i  c! t( ^6 m: M4 HAny Chinese national who has settled abroad and who has  been  naturalized
1 S) s3 F: s  \3 v$ T$ ?as a foreign national or has acquired foreign nationality of his own  free
2 ~: M! d. t* c2 j% ?! Iwill shall automatically lose Chinese nationality.$ G! n  c5 _. x
Article 10& [1 p$ c6 R5 m/ {
Chinese nationals who meet one of the following  conditions  may  renounce
# p: {/ }0 s* I# @. W5 R* i) k4 I( u/ RChinese nationality upon approval of their applications:  c- L/ H: Z3 G& W* x1 N" l$ ^- s
(1) they are near relatives of foreign nationals;
: |( E* {) l: `6 `4 Q3 R5 Y(2) they have settled abroad; or# s2 ]" Y2 R- M: ^; C) t7 `
(3) they have other legitimate reasons.
4 x4 ]: c) s. D: }, R& v  ^4 qArticle 11- H( a* \- L; f0 [
Any person who applies for renunciation of Chinese nationality shall  lose3 t( S8 L5 O$ J4 a7 G
Chinese nationality upon approval of his application.8 @' Y* O( _6 M8 o
Article 12
' \: n7 S) a# S0 d; W; x1 B$ DState functionaries and military personnel on  active  service  shall  not
; j9 y  G3 W0 frenounce Chinese nationality.
- m8 e' b; k7 L% q2 H# YArticle 13
( j! k8 y+ [# }% O( B+ _' YForeign  nationals  who  once  held  Chinese  nationality  may  apply  for  }$ g1 S: I/ \, M* j+ C
restoration of Chinese nationality if they have legitimate reasons;  those
3 h0 T! b9 g% T. [  Ewhose applications  for  restoration  of  Chinese  nationality  have  been& }3 Y' s( m" z/ C! Q
approved shall not retain foreign nationality.
3 d* d+ @: }4 p$ t# NArticle 14
! i+ `2 J; s/ N, g- K0 l1 u3 Z: r+ TPersons who wish to acquire, renounce or restore Chinese nationality, with
0 n( W- C% F; [6 f7 G( Qthe exception of the cases provided for in Article 9, shall go through the
4 w' z, b0 w% C" zformalities of application.  Applications of persons under the age  of  18  Z  p! w: ~( M
may  be  filed  on  their  behalf  by  their  parents   or   other   legal
5 C  f( r6 i* j$ J) x6 O6 w4 Hrepresentatives.$ b2 R/ R; `9 J. y  X( y( J, t
Article 15& M; T% z0 B  z& O
Nationality applications at home shall be handled by the  public  security' A0 K. Z8 b9 g2 o5 l
bureaus of the municipalities or counties where the applicants reside;, ~, Y3 g# G/ J2 f6 W" _, m
nationality applications abroad shall be  handled  by  China''s  diplomatic
- R* n$ v1 V8 P0 o& |. T  D% Grepresentative agencies and consular offices.& y6 B; m; X# ^" ~
Article 16& M( K# H) t+ o6 O
Applications for naturalization as Chinese nationals and for  renunciation
+ X: F8 d! y1 J3 t: `3 Lor restoration of Chinese  nationality  are  subject  to  examination  and3 h+ D5 f4 [" U7 J7 p, ^
approval by the Ministry of Public Security of the  People''s  Republic  of
+ n  ^2 ~, M' y0 RChina. The Ministry of Public Security shall issue a  certificate  to  any
& r* A7 L, w% F' \person whose application has been approved.
) x+ x) W9 R, qArticle 17
5 C; O0 h# v- e% M- m, J3 y( w: |The nationality status of  persons  who  have  acquired  or  lost  Chinese
2 Z5 W- a9 n5 `7 Tnationality before the promulgation of this Law shall remain valid.
- H/ i2 \& l. G- YArticle 18
2 t5 D- b4 I% p3 P8 KThis Law shall come into force on the day of its promulgation.
