第一条 中华人民共和国国籍的取得、丧失和恢复,都适用本法。; M# y( B% y- z( s1 E- ?0 c
第二条 中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。
( G! i6 v" b& ]5 ?8 p; J* x 第三条 中华人民共和国不承认中国公民具有双重国籍。
: y; K4 o' I0 f5 k6 c 第四条 父母双方或一方为中国公民,本人出生在中国,具有中国国籍。% n. t W8 @( t
第五条 父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。
" ]/ C9 d, {8 j 第六条 父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。
2 \! h0 c9 Z, e+ J5 u/ Z 第七条 外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:
% x# H, ~4 K" c' T5 @! _ 一、中国人的近亲属;
$ ]9 B7 ^) U# J2 J5 Z9 B9 O 二、定居在中国的;
) j) s. y- a. i; E- K 三、有其它正当理由。 J: X1 T M% e- ^% y Y
第八条 申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。
7 P% O* \2 E: c, p 第九条 定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。" I/ K h7 o- Y$ @0 C8 E
第十条 中国公民具有下列条件之一的,可以经申请批准退出中国国籍:
7 p1 ]: L+ z( I8 M 一、外国人的近亲属;
1 `" s8 L$ _: t 二、定居在外国的;/ C0 X& [2 f& O A
三、有其它正当理由。5 E) C7 {9 F/ d0 E; S) b! ~
第十一条 申请退出中国国籍获得批准的,即丧失中国国籍。
4 _" }: v4 Q. a# Q$ {8 X, H6 M 第十二条 国家工作人员和现役军人,不得退出中国国籍。
& n2 s. X% D7 G% N8 ^- ~ 第十三条 曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。
2 g1 b% \7 b+ c* Z. b7 G3 [; R 第十四条 中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。
% d% ^/ ~$ C( U u 第十五条 受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。) S0 t# \" t: g
第十六条 加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。, E5 \6 Q+ }5 _( y t% ]& }
第十七条 本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。

Article 1
0 K# C! J! s) H! pThis Law is applicable to the acquisition, loss and restoration of$ Q# D" Z/ j2 @- }3 w( A7 \" y
nationality of the People''s Republic of China.

, h* \- x9 G- U6 |* OThe People''s Republic of China is a unitary multinational state; persons# q8 Z) q1 X9 ?: K/ b. k. y

The People''s Republic of China does not recognize dual nationality for any

6 d. l- F$ y6 fAny person born in China whose parents are both Chinese nationals or one
$ ]1 ` ~5 \- E7 {of whose parents is a Chinese national shall have Chinese nationality., P8 j% w. q4 I- P' y, [

Any person born abroad whose parents are both Chinese nationals or one of' q8 T% c; `+ e; ]) \6 J
whose parents is a Chinese national shall have Chinese nationality. But a: b1 k. E1 S0 B& _; J1 n* c' O5 O
person whose parents are both Chinese nationals and have both settled
' w# M4 y8 Z) a6 J& v/ X Z8 Dabroad, or one of whose parents is a Chinese national and has settled
2 @; \- C* s) D1 X# Zabroad, and who has acquired foreign nationality at birth shall not have

Any person born in China whose parents are stateless or of uncertain) V5 u, F. {3 ~# f8 N3 I" R
nationality and have settled in China shall have Chinese nationality.& v. ` e% m& f2 L5 b( w; r% r+ P
Article 7
4 \8 |: D h- v+ t! _Foreign nationals or stateless persons who are willing to abide by China''s
, n, z3 ~8 N0 @: xConstitution and laws and who meet one of the following conditions may be4 |9 t2 I* h/ O* e* E! b2 B
naturalized upon approval of their applications:
: y3 i% n# O% r% ~, n3 ~* F& B- j(1) they are near relatives of Chinese nationals;" t7 `- A6 X& |* Q
(2) they have settled in China; or
, g, Q6 G# k% l! @& l(3) they have other legitimate reasons.5 J9 N) i: w* }/ q, W g9 ]
Article 8
`' W8 I4 O( E4 }' nAny person who applies for naturalization as a Chinese national shall
9 J5 p5 X7 H9 Z4 t( @acquire Chinese nationality upon approval of his application; a person
" j: m" }- _+ E \6 i) Nwhose application for naturalization as a Chinese national has been, ~* v, w$ u! S d
approved shall not retain foreign nationality.
* T6 l3 k: r1 d( j7 HArticle 9
2 U( z7 Q+ A3 h [0 t) wAny Chinese national who has settled abroad and who has been naturalized
5 {) H5 }. ], n8 K8 `as a foreign national or has acquired foreign nationality of his own free0 e8 V2 X& Y- { Q# S
will shall automatically lose Chinese nationality.9 K5 O0 \( o) M
Article 104 ~* j: C1 O/ Y) ?) v
Chinese nationals who meet one of the following conditions may renounce
Q) H4 v/ I6 IChinese nationality upon approval of their applications:
8 a* M; K! P0 O(1) they are near relatives of foreign nationals;; y$ B/ S% l9 F. j
(2) they have settled abroad; or r! Y; k6 d& ?7 M! d. T
(3) they have other legitimate reasons.

Any person who applies for renunciation of Chinese nationality shall lose
5 _6 H' i# L( p& b# bChinese nationality upon approval of his application.8 R) }5 X7 T# ~$ `+ r3 C/ s
Article 12
- p5 N4 Y8 E1 `9 k6 ZState functionaries and military personnel on active service shall not, C: |; G0 Q6 J& e( C4 X7 v _
renounce Chinese nationality.. d6 l5 a/ a1 v, C
Article 136 S0 y# _/ f1 }) _5 X$ x4 t4 T
Foreign nationals who once held Chinese nationality may apply for. L4 x9 D; Z0 A* O) q4 T$ W) E! b
restoration of Chinese nationality if they have legitimate reasons; those
$ U* M2 {* ?% n8 \whose applications for restoration of Chinese nationality have been2 A; e7 r" t' Y B5 a' O! w# r! p# X
approved shall not retain foreign nationality.* T& Y* Q8 ]" g
Article 14
2 S9 y M3 o- A0 QPersons who wish to acquire, renounce or restore Chinese nationality, with
) ^ L& C4 E9 G4 ~6 Fthe exception of the cases provided for in Article 9, shall go through the$ ]! L, W2 {' ?; j a
formalities of application. Applications of persons under the age of 18* q# n# G4 c+ r+ o
may be filed on their behalf by their parents or other legal+ n9 ?. h8 @( d( ]# y. L `$ d
representatives.
6 ]& u' t, @! q m" N' nArticle 157 C2 F' B' v% S/ r- N( Q$ Q; P
Nationality applications at home shall be handled by the public security
/ P9 v, ]! n$ Vbureaus of the municipalities or counties where the applicants reside;
3 \5 ^! t* w/ ^( ^! n3 ]# ]nationality applications abroad shall be handled by China''s diplomatic
. W( e$ G! R% t/ H0 Mrepresentative agencies and consular offices.. R! W) o4 e0 V( a: Z4 h7 @9 n
Article 16/ ^5 b( X5 C" h8 \# p
Applications for naturalization as Chinese nationals and for renunciation2 F0 j" M$ c0 B% s* O9 x
or restoration of Chinese nationality are subject to examination and
3 f N5 R1 K6 t) u3 G' s# Oapproval by the Ministry of Public Security of the People''s Republic of
3 G i" V4 t A: X8 NChina. The Ministry of Public Security shall issue a certificate to any- t6 C4 A$ W+ C, p$ W* R5 \
person whose application has been approved.
! a# T* O! ~4 S6 L7 pArticle 17" m% T) C, _; m
The nationality status of persons who have acquired or lost Chinese
\& A. d1 A$ ^3 nnationality before the promulgation of this Law shall remain valid.7 e6 w6 _' [2 ~ S( A# F1 A n
Article 18# N- C- J0 ]& M/ {" L4 X
This Law shall come into force on the day of its promulgation. |
