第一条 中华人民共和国国籍的取得、丧失和恢复,都适用本法。
7 Z6 }# p, C+ V! J4 F) q0 P! j 第二条 中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。- Z1 y+ N6 k o; \' E9 M6 k
第三条 中华人民共和国不承认中国公民具有双重国籍。
4 z- p* a+ i: R1 j0 s4 ] 第四条 父母双方或一方为中国公民,本人出生在中国,具有中国国籍。# N* n( R& h* A5 b4 O7 @
第五条 父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。
+ ^" |4 N! ~ A# }; F 第六条 父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。
/ j p2 b0 U- j$ t- o 第七条 外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:! P) f! B! L% |2 E9 N( ` ]
一、中国人的近亲属;! y. Y' @* }+ w9 ^- B
二、定居在中国的;1 p3 p/ ^7 a; C- V7 ]- J
三、有其它正当理由。
, z3 W! l- r& h6 k1 A/ y6 j 第八条 申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。
" S" M" x5 c# O1 ~; i W 第九条 定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。
- w" `. G2 F* l1 K2 c) |3 o2 O3 L 第十条 中国公民具有下列条件之一的,可以经申请批准退出中国国籍:
0 l3 C ]) F2 `) \3 H! V& b 一、外国人的近亲属;2 w* m$ t0 D6 j
二、定居在外国的;
/ Z0 y: m+ ]# D8 k! j1 ? 三、有其它正当理由。
# _) d! Z4 g0 Y3 X0 l& j& @% h+ a. H 第十一条 申请退出中国国籍获得批准的,即丧失中国国籍。
( |3 ^2 S3 `9 S* r* u 第十二条 国家工作人员和现役军人,不得退出中国国籍。
! \0 a2 f' C3 L5 {2 Y# A% ]7 A 第十三条 曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。
R0 C( {$ K+ Y: M 第十四条 中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。
- e" }4 p% j4 h0 a7 \, B 第十五条 受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。3 a U/ c0 Q7 v5 V9 X4 X
第十六条 加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。3 H9 B3 ^: K6 a
第十七条 本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。3 u% g4 C$ s) M+ r8 s
第十八条 本法自公布之日起施行。

The People''s Republic of China is a unitary multinational state; persons

The People''s Republic of China does not recognize dual nationality for any

% S j/ y5 T! o! E! L5 Bof whose parents is a Chinese national shall have Chinese nationality.

Any person born abroad whose parents are both Chinese nationals or one of& ^* Q! V% R4 v4 q, A$ @
whose parents is a Chinese national shall have Chinese nationality. But a" h3 L8 P0 P+ C8 H0 t
person whose parents are both Chinese nationals and have both settled
* V) |, H& j$ E* babroad, or one of whose parents is a Chinese national and has settled
" }& p* ?% z$ K8 S" e! Z$ eabroad, and who has acquired foreign nationality at birth shall not have

Any person born in China whose parents are stateless or of uncertain

6 ?& B& M7 M1 a6 f, MForeign nationals or stateless persons who are willing to abide by China''s/ j5 L% C" s7 r1 |' u
Constitution and laws and who meet one of the following conditions may be* v& ` e! ^7 l4 z8 U: a
naturalized upon approval of their applications:+ _. K) A8 _5 k
(1) they are near relatives of Chinese nationals;
1 R+ a( B* X* [' v, W! w, `& |$ M4 R8 y8 m3 p(2) they have settled in China; or5 @9 C4 N0 o w: I7 }+ k
(3) they have other legitimate reasons.7 N2 ~7 N: J) I
Article 8
5 f, E* E2 j1 ~9 F' e5 x' QAny person who applies for naturalization as a Chinese national shall+ j1 T( ^5 P/ [
acquire Chinese nationality upon approval of his application; a person
6 [( }) V! N1 `* C5 ^' k4 g! D- \whose application for naturalization as a Chinese national has been9 o/ x8 }. f3 W
approved shall not retain foreign nationality." m1 n- |9 x4 M; {- f& g7 \- u* W
Article 9
! t0 K% v) p5 t' W1 O- xAny Chinese national who has settled abroad and who has been naturalized- q6 d: c+ g3 \% i6 D/ S/ b& D
as a foreign national or has acquired foreign nationality of his own free
$ E4 k, x* {- o. \$ jwill shall automatically lose Chinese nationality.1 M5 h( u( K) t8 R1 ~) {. ^5 R( r
Article 10
: j3 m3 s7 j8 DChinese nationals who meet one of the following conditions may renounce
7 J0 R' g$ o; SChinese nationality upon approval of their applications:
& e0 Y& I9 z$ d! P6 a9 [% X+ c5 R(1) they are near relatives of foreign nationals;
5 ~# N' r! j9 `4 X" d- X(2) they have settled abroad; or
# e6 o. a$ A: u! ~(3) they have other legitimate reasons.. Z) O9 z* x9 S. [7 u
Article 110 X3 K9 ]7 S; q9 Q6 i8 } G' d
Any person who applies for renunciation of Chinese nationality shall lose
' Z" f2 o8 O* c; q; j; ?Chinese nationality upon approval of his application.( k9 g6 i- | ], j. n% q1 E( j' x2 m
Article 12+ u3 l/ |# |$ u" {+ t* ?6 `
State functionaries and military personnel on active service shall not E- u! L; d8 q3 q7 I7 ]3 F# z
renounce Chinese nationality.5 o- o! H, c' H% }7 N6 G
Article 13
. B4 }$ Z5 d; H5 u+ XForeign nationals who once held Chinese nationality may apply for
1 w/ K6 V" c: g d$ d4 F$ wrestoration of Chinese nationality if they have legitimate reasons; those( E8 f7 B, }& K, I: M
whose applications for restoration of Chinese nationality have been& x; `! b9 y2 G4 M v
approved shall not retain foreign nationality.
8 ?; p5 x2 F6 O. `: EArticle 14: W# {7 v0 Y4 M8 C# n
Persons who wish to acquire, renounce or restore Chinese nationality, with
0 ^6 w4 q3 @% D! p+ n6 v; a) cthe exception of the cases provided for in Article 9, shall go through the3 V' L# p6 M$ u1 R4 n! ^
formalities of application. Applications of persons under the age of 18
/ Q' d u+ Z+ c. }% A5 Smay be filed on their behalf by their parents or other legal5 d9 n8 J5 U) h. D$ k
representatives.2 E/ H3 M/ T2 C
Article 153 d2 z1 s' q# F0 V
Nationality applications at home shall be handled by the public security4 k; T; m& i* _; b! x$ C' R$ \* q
bureaus of the municipalities or counties where the applicants reside;
' X f2 x" e1 K, Hnationality applications abroad shall be handled by China''s diplomatic
6 T% X, T. U, B1 w0 drepresentative agencies and consular offices.

) o- l- s( ]0 o! vApplications for naturalization as Chinese nationals and for renunciation- K$ g. Q3 A+ s0 \* k" T0 K
or restoration of Chinese nationality are subject to examination and
0 n: H8 i ?0 @# [! Papproval by the Ministry of Public Security of the People''s Republic of
1 r/ w$ N% l w* E4 T" I o% {China. The Ministry of Public Security shall issue a certificate to any
. ~, y. a( o/ w' C" Uperson whose application has been approved.

The nationality status of persons who have acquired or lost Chinese
( _' i: @: N* s$ vnationality before the promulgation of this Law shall remain valid.+ f" K. J4 Z% T9 S( E7 _3 A# k$ v" I

This Law shall come into force on the day of its promulgation. |
