(1)
* l: o* X x% B( q. t3 K% \9 fExcept as otherwise permitted under this Act, a person shall# Y' U9 P; Y# J- O4 B4 p
not do any of the following:0 s" Z- [& T1 G: P4 r; d- f
(a) drive a motor vehicle on a highway unless the motor
" ^9 B) x4 A \ t, C, ?vehicle is an insured motor vehicle;9 Z# Y2 [+ T) { D6 Z, Y% X+ @% N* d
(b) have a motor vehicle on a highway unless the motor
3 G# s6 B( I) c7 Nvehicle is an insured motor vehicle;
: B y2 ]# [; F+ z! {3 z6 n(c) where a person is the registered owner of a motor vehicle,
4 O7 h8 n) Z7 O/ V% n, C: ` v `permit another person
( ~* D- z: {( _# ]8 {(i) to drive the motor vehicle on a highway, or# g! [& s/ r: a% |0 j
(ii) to have the motor vehicle on a highway,& K* [! x. H }) g2 x
unless the motor vehicle is an insured motor vehicle;
0 r3 J( _4 t# T5 V! ^. h8 {/ n4 n(d) give or lend a financial
. m2 @9 e! e9 P5 p& M; d* Kresponsibility card or a copy of it# a0 Z) ~9 W, V" ~3 i
to a person not entitled to have that financial
7 Z7 g; _, `* c- Presponsibility card or copy.

If a person drives or has a motor vehicle on a highway6 J" H4 d4 t) Z: ^* f; d9 Y
without the expressed or implied consent of the registered owner of/ Q) T$ f2 N9 H3 T2 M' [8 p
the vehicle, that person is deemed for the purposes of subsection, b# _# y3 @0 N* Q) c \+ V
(1)(a) or (b) to drive or have on a highway a motor vehicle that is
3 ?* Z; H' {! _not an insured motor vehicle.

If the registration of a motor vehicle is suspended under this
' Y0 @1 C" Q/ ]. b, C$ R; m. u1 KAct, the motor vehicle is still registered for the purposes of this

5 O( U/ c$ H2 T6 q0 bSubsection (1)(a) and (b) do not apply to a person to whom a
% w0 c) w; D8 i9 z8 _' bfinancial responsibility card has been issued pursuant to the- W# |/ @* Y$ T) ^
Insurance Act" `& F# @* ?3 F U, Y
by an insurer who has issued an owner’s policy3 J) l( Y6 c; Z' v
outside Alberta.
F* T$ J \! I* v(4)! R6 f' {% ^+ [; R+ U
A person, other than a corporation, who contravenes subsection. r2 x) m# ?9 O$ F8 _
(1) or section 52(1)(h) or 167(8) is liable,5 D% O0 K/ @3 r |' T. Q5 o# q& O
(a) for the first contravention, to a fine of not less than $2500% g: m% D8 Q4 O! n
and not more than $10 000 and in default of payment to
: A7 A, y. t% P' ]( o4 y+ Bimprisonment for a term of not less than 45 days and not9 d! C4 ]6 X( G( ? X
more than 6 months
8 s* E: q0 _- n$ D& X/ F7 y$ X9 ?. s$ y" @3 z
Minimum $2500, if you don't pay, you will go to jail for a minimum of 45 days. |
